Set (m) financial requirement.

Hi all I need your help.

My mum will go to peo 29th of May for her ILR. she initially granted her spouse visa in 06/2012 and for 2 years period.

1. Is she under the old rule which can apply ILR after completed 2 years stay?

2. She has no job since she came here so she has no income. They have saving around 4k in joint name and her partner has 40k saving in his account and also around £750(after tax) pension PCM. They have thier own house so no need to pay any rent or mortgage. My question is do they meet the financial requirement for ILR?

3. They have cohabitation documents as below
Joint name- council tax 2013-2014 and 2014-2015, joint bank statement 2012-2013 and 2013-2014 as they are saving account only come yearly, 3 holiday letter content both names.

Her name- bank statements every months for 2 years, nhs letters, utility bills

Her partner- bank statements every months for 2 years, pension letters, tv licence letter, utility bills, home insurance letter.

Do you guys think those documents are enough to prove the cohabitation?

4. Some of the letters her family name changed to her partners family name, is there any concern about this issue?

Thanks for you quick reply. I have read the adequate maintenance link. And wondering in my mums case does she only need to meet this adequate maintenance? No any other finacal requirment? Aslo could you please answer my rest of questions? Many thanks.

One more question: do they need to sigh and date on page 32 of set m? The question on page 32 is " if the account with the bank or utility company relates to another person who is to provide the applicant with financial support, that person should sign the following declaration"

Does "another person" also mean her husband here? Please note none of her friend or relative give her finacial support. I personally think it should be left with blank, am i right?

They have three holidays been out of country for about 45 days. Do you think that i should put any explaination regarding this absence? Not seen any section ask about it in the set m!

Amber what if sponsor is not working and applicant alone earns more than the required £18,600, should that be any concern?
