What went WRONG?

hi Forum,

I got to know about my HSMP rejection today. I specifically requested for a courier pick-up, but my caseworker missed it and sent my documents by Airmail. So the long wait starts to know the reason for refusal (It takes long for the airmail to be delivered in INDIA).

In the meanwhile, I would request you all to share your views as to what could have gone wrong here.

My timelines:

Application Submitted: 4th July
Application reached HO: 9th July
Fee debited: 10th July
Got Reference Number and Payment confirmation: 11th July
Sent additional documents: 23rd July (BANK STATEMENT)
Assigned to caseworker: 25th July
Additional documents reached HO: 26th July
Decision: 30th July


DOCUMENTS SENT:
----------------------

FOR AGE: DRIVING LICENSE (20 points)

FOR QUAL: MBA DEGREE (35 points)

FOR EARNING: SAL SLIPS (signed+sealed), ITR, Original Bank Statement (30 points)

LANGUAGE: TOEFL (HSMP guideline mentions certificate equivalent to IELTS 6)

Couple of things I would guess


a) FOR EARNING: SAL SLIPS (signed+sealed), ITR, Original Bank Statement (30 points)


Along with the above list you should have submitted a letter from your employer explaining the gross salary for the claimed period. There is a clause in the guidance note which states either Bank statement or Employer letter or Both. This could be one reason


b) TOFEL. I guess this will be considered only in exceptional circumstance. I don't know what exceptional circumstance you cited. Is this equivalent to IELTS band 6 score ?

Hi PG,

For EARNING:

I had submitted the two primary evideces (IT Return and Pay slips), Bank statement was an additional document.

TOEFL: The link on ETS website claims that TOEFL is acceptable at HO:

it can also be possible that ITR being a new format for IT returns was not known to the Case worker and he was expecting saral form. In your covering letter did you mention the change

Hi cdraina,

Sorry to hear about your rejection.

It could be the ITR1 form which they didnt know or the Toefl being an exceptional evidence. Had you mentioned the reason for exceptional documents being submitted?

Regarding ITR1 form, I had today received a mail from HO stating that any changes in the international tax system would be communicated to all of them. The person who had mailed also mentioned that he would forward this to HSMP team. So it could be less likely on basis of ITR form and more of Toefl.

However once you receive your documents, you try applying for a review based on the reason for rejection.

I dont see any problem with TOEFL, where the following link from home office confirming that its indeed equal to IELTS

I am wondering whether you requested exceptional circumstance or not?

even you ticked under exceptional consideration, you must have to explain the reason --where H.O is very concern about the reasons for exceptional circumstances.

I just called the HO and got to know that my application has been refused due to TOEFL. They don't see it equivalent to IELTS.

I will apply for a review of the decision, quoting question 39 of the FAQ.

I understand for MBA you can claim 75 points but you have only claimed 35 points.

From where you have done your MBA...

I did my MBA from India and none of the Indian MBA's are covered in the list of institutes eligible for 75 points.

Sorry to hear about the refusal. Didnt expect it.
2 reasons i feel ~

1) when you submit TOEFL scores, you also need to send across a letter stating that so n so TOEFL score is equivalent to IELTS 6.0 and above. also, need to tick the exceptional evidence.

2) normally the HO guys dont disclose the desicion over the phone. So, I hope and pray that it must be mistake from them and you have a good surprise packege :) (pretty lame thought)

Dear J,

Had a detailed discussion about my case with the customer representative.

I have been awarded points for the following sections:

Earning : awarded 25, claimed 30
Qualification: awarded 35, claimed 35
Age: awarded 20, claimed 20

Total: Awarded 80, claimed 85

Caseworker did not consider my TOEFL score (290/300) as equivalent to IELTS 6. HO has recently started accepting TOEFL scores and hence I guess the caseworker was not very familiar with its equivalence.

With reference to what Suresh has posted on this thread, I look forward to request for a review.

I just wish that your POINT 2 is true :P

though u claimed 85, is 80 points not sufficient for a successful decision? do they decide with the points claimed??

My application was refused since I submitted TOEFL for the English language critera.

I have been awarded points enough to clear the 75 points cut off.

Hey CD.. this is really sad that HO does not pass on the relevant info to the caseworkers and create unnecessary delay for us..

I am also planning to apply this week and I am also planning to apply with my TOEFL score 293/300. I gave exam in Aug last year, so score is still valid.

Please let me know if you come across a solid reason of this refusal on basis of TOEFL.. I hope its not because of the CBT and IBT differences or because you gave the exam more than 2 years back.

In my cover letter, I am actually giving the link and copy paste of Q39 of hsmp faq. I hope the caseworker would read.

Please let me know if you have any other ideas..

Here's the mail that I wrote to HO guys and their VERY HELPFUL response:

Dear cdraina

Is your TOEFL score is still less than 2 years old or is already over 2 years old ?.

-If is is over 2 years old and U r not working/living in the UK (or othe english native xountries) than you might forget Review and better you file up a new application with new IELTS.

- If less than 2 years old than you should try as you have nothing to loose. THis is actually still a gey area and each caseworker might have different interpretation.
