IRL failed instead DLTR - When can I apply again?

I applied for ILR in January 2014 and today got my documents back. Letter states I have failed to provide any evidence that you have acquired the requisite English Language qualification, and you have not sought an exemption from KOL. However they have granted me a further period of discretionary leave to remain for another 3 years. My dilemma is when can i apply for ILR again ? Do i have to wait till 28days before this discretionary leave to remain expires or can I apply as soon as I got my English test done?

Any help would be appreciated.

yes it is and I've been here since 2001 (was a student before)

Yes, for settlement.

It does state that you did not apply for exemption -

• Nationals of majority English speaking countries (Annex A).
• Those who have obtained a degree taught in English.

If either apply you are exempt from the B1 but not the LIUK requirement.

I am confused to how to apply for exemption? As I am a Malaysian Passport holder and I have only got Foundation degree in Retail Management.
