ILR Urgent help needed

Post by rwhizza » Sat May 31, 2014 10:29 pm

Dear Members
I am due to apply for my ILR 10 years in 2 weeks. Currently on Tier 2 Issued on October 2011 Valid till October 2014.
My issue is a criminal conviction I had on 8th March 2012 for possession of Uninsured Vehicle. I got 6 points on my licence and £220 fine which I paid. The investigation started in July 2011 and I had a police interview in NOV 2011 and court letter appeared in December. (haven't got exact dates).
My issue is that I failed to declare this incident on my previous application under a section which says . Have you ever been charged or indicted in any country with a criminal offence for which you have not yet been tried in court? Although this offence will not affect my application as I have already spent 2 years but declaring it on my application might throw me into hot water. although I don't have exact dates but police might have charged me with this offence before my application . I prepared my application myself and made the mistake. Apart from this incident my time in Uk has been trouble free with 5 years as student 2 years PSW and 3 years Tier 2 and no gaps between application. I hope someone can share there own experience. Will this ignorance get me banned from reapplying for 10 years.

You should declare the conviction, as 24 months have elapsed, you should be ok, the deception in the other applications made after the conviction, would be subject to the caseworker.

Criminal conviction was made after the application submission.
Tier 2 issued November 2011.
Court Issued FPN + Fine March 2012.
I was hoping that there is someone with similar situation who either got their ILR accepted or rejected on these bases.
I will obliviously declare this offence in my application.
