Spouse visa help please

Post by Prince_irl » Fri Jun 06, 2014 2:02 pm

Hi all, it might be not new for ppl to see same topic or it may repeated again and again. But reason for posting again is might be the situation and my experience may be different. I am British citizen and working in London. Now want to move to Ireland to call my family from Pakistan. Contact with irish consalate in Karachi. Asked them about documentation I will need to apply for visa. They gave me the long list of documents like bank statement, letter from job , fees and so on....... I explain them about my statuation that I am EU citizen and I don't need such documentation. But they respond that if I can't provide that documents my visa will likely to be refuse. I cheated directive 2004/38/EC the list is very limited list of documents. I sent email to SOLVIT here in uk. They gave me response
If your non-EU family members need an entry visa, they should apply for one in advance from the consulate or embassy of the country they wish to travel to. If they will be travelling together with you, or joining you in another EU country, their application should be processed quickly and free of charge. However, documents your family members will need to include in their visa application may vary from country to country. You may wish to consult the harmonized list of supporting documents which can be found in annex II of the Visa Code (Regulation 810/2009). For precise information on which documents you will have to enclose contact consulate or embassy of the destination
. But for me I have not seen any thing like that. For me directive2004/38/EC is very clear and straight fwd. any suggistion from any body ....???

I don't understand why people are very hesitant to supply the requested docs by the consulate/Embassy. Every consulate/Embassy have different requirements and that vary from country to country. I would suggest to provide them the required docs and make your situation easy.

If you are working in London, you should have no problem to supply them a job letter, payslips, bank statement etc. I knew some one that was in the similar situation and just like you wanted to bring her wife from Pakistan was hesitant to supply them docs and the wife visa got refused. He ended up providing the same docs at the end and his wife visa was delayed for about 8 months where he could save all the hassle, money and time on the first place.

I know alot of people from the UK are moving to Ireland to bring their families because UK have a salary condition.

Good Luck mate and i would advise to provide them the docs what ever are required to make your life easy.

Thanks for replying. This not question about scaring provide documents. But as I am in London at the moment I don't have job in Ireland. For moving getting job opening bank account and running bank statement required another six month or so. That's why we try to avoied such statuation. If it is enough to provoied uk base job and bank statement and payslip I will be not having any problem

I think you can only apply for family reunion visa for Ireland, provided you are living in Ireland. You cannot apply for visa for family staying outside Ireland and also with out your proof of stay in Ireland.
So you need to come over here and get the necessary proof documents and then only apply.
If no proper proof of documents chances of visa refusal will be very high.
With out your employment here in Ireland, you cannot survive along with family.
Also you need to show proper available funds for you to sustain with your family. As a EU citizen you can visit, stay or work but there will be restriction to family members.

That's right, I only sent a photocopy of my passport. I was in Pakistan at the time so I applied for an 'Accompany' visa. If you intend to travel to Ireland before and are not going to be on the flight together with your spouse then you need to to apply for a 'Join' visa.
If you want I can share my cover letter which I sent with my visa application.
