Is 2 years cohabitant compulsory for married partners who are applying for FLR (FP) ?

Thank you everyone for being supportive , the support system on this forum makes me feel confident. In response to Zico I don't have any kids. Even with kids the ukba are not considerate , I have seen people on this forum with genuine cases yet the application gets a refusal. @ icehouse am not married it's under unmarried couples.

Hi

I've been reading these posts with interest, how many people are applying flr(fp) with a partner classed as an overstayer (my husband's original visa expired after applying spouse visa which was rejected hence now seen as overstayer).

Also anyone applying whilst uk citizen only working part time? I'm applying for jobs like mad as my exams have finished but just wondering what everyone else's cases are?

Good luck everyone!
Flr(fp) application.

Applied - 29/07-14

zico 10 wrote:one thing i have notice here is partners who have not lived or cant prove 2 years cohabitation are been refuse. and the important question i have for this great forum is this.
1,is it that partner who have not lived together for 2 years cannot claim article 8 right
to family life, meaning they have to be together for 2 years before family life can be establish?

I think 2 years is just to prove a subsisting relationship, preventing sham marriages or as they call marriage of convenience...

2, what about partner with kids but have not lived together for 2 years?

well there are applications that can be made based on the child

3, This element of Article 8 protects your right to respect for your close family relationships and matters relating to those relationships, for example how parents choose to discipline their children. The question of whether a relationship will fall within the ambit of ‘family life’ for the purposes of Article 8 will depend on the nature of the relationship and the existence of close personal ties. In addition to the relationship between a mother and father and between children and their parents, ‘family life’ will include unmarried couples and the relationship between an illegitimate child and either parent as well as other family relationships, for example relationships between siblings and between adopted children and adoptive parents.

please great people with great mind please am really confuse about it is compulsory to prove 2 years cohabitation. please i don't know and i will like to know. thanks

2 years is to prove the validity and sustainability of relationship, marriage is easier in the terms of you don't need to prove 2 years cohabitation. Either way the proof is important, correspondence, supporting letters, various photos...

Hello everyone, it's been a while since l logged in. Congratulations to everyone who has been granted and those who have been refused, don't give up. My FLR O application was refused last year June( had applied on basis of British partner and child), My solicitor sent the Home Office PAP which was not considered. In November l received IS 96 and was told to start signing. I contacted my MP in May 2014 who in return wrote to the Home Office, he received a reply that they refusal still stand and that l should re-apply or go back home. My question is I want to make a fresh FP application now, my wife n l receive housing benefit and she works only 20 hours a week will this affect the 10 year route application? and we have since married. Thanks in advance for your reply

@ rina,
I have not received this before but I am sure I received a notice of decision when I was refused last year and it stated that I had to call some numbers. I am not sure this is the same.
However in a quick on line search I found this
http://spammer.co.uk/practice-areas/depo ... rs-london/
You could also do a quick search in the forum. I know first hand information is better though. i.e. speacking with someone who has received one.
I hope this helps.

It also generates a right of appeal, I believe.

@helpme123
If you get a refusal and it states that you can appeal the decision. This means you apply to the fisrt tribunal and I believe it is 10 working days. It is also stated on your refusal letter, i.e, the deadline. this appeal could be in paper/ you could appear in person.

JR=Judicial Review- It is used to appeal a decision / lack of decision by any authority.

But in our case, (Home Office/Secretary of State); this generally resorted to when you have no right of appeal when they make a decision.

I hope this is helpful

just replace "spammer" with this "spammer.co.uk" in the and copy the address into a new browser.
I believe that should work.
