Absenses from UK (Tier 1 General)

Please can someone answer my query

I am applying for ILR soon, since my first grant of leave (2009), i have been out of country for about 133 days, this also includes 4 holiday trips to europe totalling 8 days.

1. Please can you advise if i need a letter from my employer regarding these absenses or will it be sufficient if i fill in the details in SET(o) form?

Yes you can apply for ILR, But for 133 days you need to provide an employer letter .

I had 177 days absence in my first year of Tier 1 visa. I submitted medical certificate for 177 days. I was not even working at that time. My visa was accepted without any question at the croydon office.

One quick question, what kind of medical certificate you provided. Is it NHS letter or your home countries medical certificate .

It was a medical certificate from India and not an NHS one. When I applied for my ILR this rule was just introduced and people were very confused(proof of absence rule)..from my understanding they are not really worried until the absence is not more than 180 days in one year.

This is copied from the guidance.

No more than 180 whole days absence are allowed in any of the five, four, three or two consecutive 12 month periods, depending on the category, preceding the date of the application for indefinite leave to remain (ILR).
The specified continuous period is counted backwards from the date of the ILR application. For example, if the date of application is 11 November 2012, the consecutive periods would be as follows: Year 1 11 November 2012 to 12 November 2011
Year 2 11 November 2011 to 12 November 2010
Year 3 11 November 2010 to 12 November 2009
Year 4 11 November 2009 to 12 November 2008
Year 5 11 November 2008 to 12 November 2007

So, list every absence from the last five years in the form (that’s a must) even if it is for as short as one day, but provide a document only if there was an absence of 180 days (in one slot) or more.
