Re: 18 days short in 10 years rule

I came to this country on 18/09/2004 and my current visa (Tier 2) is expiring on 31/08/2014. Now i am 18 days short of 10 years. Can some one please let me know if My application will be accepted? I know we can apply 28 days before we complete 10 years and my 28 days fall in Aug and i would still have a valid Visa.

I would be very great full and if some one can share their experience or know the exact rule for my case.

Many thanks in advance!

Sohail
Hi Sohail,
You can apply 28 days prior to your present expiry date of 31/08/2014, you don't need any precedents to rely on, it is general rule, so many members have applied like this and got sorted already. So not to worry at all, stay positive, get your application forms and documents ready, and get the ball rolling  . All the best with your application.
Kind regards
Shahjee

Dear Amber
My wife and daughters visa going to expire on 30 th June.
My set LR application still pending.
I'm planning to apply this week for my dependants.
I was on tier 4 before, and I do not qualify for minimum income threshold.
Which application do you suggest for them.
FLR(M) or FLR (FP).

Kind regards

If you apply for FLR(M) under Appendix FM but do not meet the Financial Requirement (but meet everything else) then the application will be stayed until the Court of Appeal (or perhaps Supreme Court) decision is made.

Hi experts,

I have recently received ILR on the basis of long residence. I had to send my wife's dependent (FLR M) application before 6 April 2014 while my application was still being considered. She had received a letter from Home Office, just like some other members' dependents had received, saying that her application will be on hold until the main applicant's case is decided. Now that I have received my ILR should I inform the case worker about it who is considering my wife's application? If so, should I call the case worker or send her my approval documents by post?

Your reply will be appreciated.

Best wishes

Hello ma575,
I am in the exact same situation as you are, what I have done is that I have prepared a covering letter explaining that my wife is pre July 2012 PBS dependant and FLR(M) send is pre 06th April 2014, hence she is eligible under the old rules of section 284 of part 8 of Immigration rules rather than Appendix FM, which is the new rule. I hope that this will help the case worker make a correct decision on her case, and obviously I will be sending the copies of my biometric card and photo copies of all the pages of my passport along. I will be sending all this to the Croydon address that is on the FLR(M) guidance notes, where by it clearly says that if you want to send any additional documents than you send it to this address.
I hope it helps.
Kind regards

Hi mumussaf and Shahjee,

Many thanks for your kind messages. I have just called home office, and the lady has advised me to write a letter to the case worker and explain my situation. I have asked her should I send the letter to the case worker and her response was, 'Yes, send it to the case worker and if the case worker needs any further information he/she will write back to you.

So Shahjee are you pretty sure that we should send the letter and supporting documents to Croydon address instead of the case worker directly? I believe that we should send them to the case worker directly as the lady in the home office customer services has advised me so a short while ago. I look forward for your reply.

Best wishes

Hi ma575,
My problem with sending it to the case worker is that in our case the name was there for the case worker and underneath it says (Temporary immigration team), so what if the case worker have moved on, as he or she was a temp. That is why I looked around to see what could be the alternative, and when I go through the FLR(M) guidance notes, the address was clearly there, stating if you want to send any further documents you can do so by writing to this address...... It's an address FLR(M) Initial consideration Unit. Croydon.
What I will do is send one to the case worker and one to the initial consideration unit  what do you think?
I think there is no harm in doing that.
Kind regards
Shahjee
