Tier 1 to ILR: 180 days/Absence query

Hello everyone,
Please could you help me with my query below.
I am on tier 1 general visa, and have been outside UK for last 8 months (continuous period) now. I am planning to come back to UK in a week or two for my extension.
I would like to know what is the chance of me getting ILR? I spoke to a solicitor and he mentioned that we could apply ILR at the time in such a way that 4 out of these 8 months will fall in one year, and the other 4 months in another year.
Is that ok or do you see any problem with that? As mentioned earlier, I have been outside UK for last 8 months continuously. One more thing is I have been working from home during this period (most of the times full time 37 hr/wk), so have got paid. Do we need to provide any letters while we apply for ILR?
Please could anyone help me what are the chances of me getting an ILR?
