Switching Tier 1 to Tier 2 When Tier1 was in appeal

Hai please can anyone help me ..It's very Urgent. i applied to tier 1 entrepreneur and refused then appeal is in pending now. one company is ready to sponsor me ,they applied for licence 2 weeks ago . Do I am eligible for tier 2 general sponsor visa while my tier 1 is
in pending..

please i will be thank full to you guys if you could respond ASAP..

Yes u can apply
I was in same situation and I applied two weeks ago and waiting for bio metric

hai navaid thanks very much for reply can you please tell me in detailed what you have done exactly have withdrawn application first or after apply u done withdrawn Tier 1 ..do i need to withdraw with previous laywer or is it ok through new laywer and any covering letters invalved in this fresh application..please ..

Actually my appeal was dismissed in upper tribunal after that I applied within 28 days
I attached my last tribunal letter with application
