Thanks for the attachment Khan 81

I have gone through the attachment but cannot see anything in regards to fresh application.

one is talking about PB applications and varying your appeal application. In my case i am not doing both.

Please explain how this is linked to my case

Your help is much appreciated

Thanks

Kind regards

FLR(m) to SET(m)

Post by HowILR » Thu Jun 19, 2014 3:45 pm

Hi all,

Just been to croydon today for my mrs Successfully granted ILR as she got flr(m) on 12/05/2014 for 2.5 years incorrectly latter i have corrected to 2 years.

Straight forward case explained everything on cover letter so that case worker didn't asked anything but i asked case worker she applied before 06th April and he said doesn't matter 06th of april as long as she has granted pbs dependant 09/07/2014 and u got ilr based on 10 years and she has completed 2 years qualifying period so then she will be eligible for IlR.

We had appointment on 10 am submitted all docs around 10.30 and came back with Ilr around 12 o'clock even-though it was mad busy there.

If anyone need any help pls ask me as i got unlimited help from this forum. Everyone here is extra level genius...thx to all.

Thx to almighty allah no need visa anymore in life time.

Hi shoji147,
Don't you worry your self, you are almost there, you will get to hear the good news soon INSHALLAH.
You can call Home Office on 03001232241, and than option 2, be ready with your Home Office reference number as they will ask you for that.
We have all been through this anxious wait and I know it is frustrating, but please don't as you are almost there. Keep us posted mate, I wish you all the best.
Kind regards

Hi SHAHJEE, RANA ALI & HOWILR,

Congratulations to both Rana Ali and HOWILR and hope Shahjee will also get his Mrs. ILR as well soon insha allah.

I have a query or rather a clarification and your responses will be appreciated. I have recently got my ILR approved and afterwards my wife got two years FLRM visa, application sent before 6 April 2014. However, my status before sending my ILR application was student and my wife obviously had Tier4 Dependent visa before switching to FLRM for two years. For her ILR application, the first sentence in the approval letter she has received says,

'In order to qualify for settlement you must have completed a period of 2 years in the United Kingdom as the spouse.'

It also says:

'Please understand any future application that you make in the marriage category will be assessed against paragraphs 284 or 287 or 295D or 295G of the immigration rules.'

My question is: Do we have to wait for two years in order to apply for her ILR or the time she has spent in the United Kingdom as a PBS Tier4 dependent will also count towards her two years.

She was granted Tier4 dependent visa before July 2012.

I have to wait as I have already done something which seems to be wrong..

Please can some one share the policies and procedures for appeal and fresh application??? so i can go to my solicitor with the printout.

Thank You
@Melani
I can assure you that you can put your ILR in while your appeal is it pending. Your solicitor sure know what he is doing, I read on the guidance on HO page under 10 years long residence, that this is possible. When they receive your application (ILR), they will void the application, then create a new file with your void ILR application and send to presiding officer unit to link to your appeal. They would then refund your money and write you a letter explaining what will happen.

For better understanding it will worth if you have a read yourself, but please don't withdraw your appeal for any reason.

Dear same situation here.
My wife and daughter visa going to expire on. 30th June 2014.
My wife came in 2011 with my 4 months daughter.
For your child who born here, just apply MN1 ( citizenship straight away. He or she ( you didn't mention boy or girl) is not under immigration control.
You need to apply for your wife and elder child.
Now question arise which form?
Either flr(m) or flr(p).
I consulted my solicitor and he said he will apply under FLR(m).
Anser we can discuss in detail just Private message me your no.

Hi Ma14, my passport is with the HO since Sept 2012 too, I had an appeal hearing at the UT on 03/06/14 and I can empathise with you as this can be really frustrating, you have been waiting for 20 weeks already. I think you should write to them, but can they invalidate the LR application because of the appeal ( Experts please shed some light ). My solicitor asked me to put in my Set LR application that my passport was held by HO, now I am terrified that they will ask me for my passport as they did to you. Best of luck, I will pray for us.[/quote]

they requested my passport from appeal department i think so you misunderstand my lines sorry. its department to department request
