Faisaltanoli------if we take this case further do u think they will listen to us they will say this is rule either take it or dont....and it will take ages in the court to get the decision .....

I am talking about Judicial Review through Court and the have to listen what ever court will say.
I do not think it will take 5 years, which one have to wait i he comes under hammer.

I hope this is the right topic to ask my question.
I am going to apply my 10 years long resident SET(LR) application but I got some gaps between visas application and want to make sure those doesn't break my 10 years long residency.
I submitted all my application within UK before my visa expired but home office usually return the visa with 1 or 2 month gaps with previous one and one time with one and half year gaps. I would like to know is it OK for my 10 year long resident SET(LR) application. I have all the proof likewise, application copy, refuse letter, appeal letter and decision, letter from tribunal service for hearing and decision, ect.

student visa: 20/01/2004 to 31/10/2005
- Submitted the visa application to extend my student visa on 01/11/2005.
- Received the acknowledgement letter from home office on 07/11/2005.
- Granted on 04/12/2005

student visa: 04/12/2005 To 01/03/2006
- Submitted the visa application to extend my student visa on 27/02/2006.
- Received the acknowledgement letter from Home Office on 28.04/2006
- Granted on 16/05/2006

student visa: 16/05/2006 To 31/05/2009
- Submitted the visa application to extend my student visa on 31/03/2009
- Received Biometric Appointment letter from Home Office on 07/04/2009
- Enrolled finger print on 17/04/2009
- Received refused letter on 14/11/2009
- Received letter from Tribunals Service about Notice of Hearing on 07/12/2009
- Attended the hearing on 04/02/2010
- Allow the appeal on 11/02/2010
- Received letter from Home Office on 01/11/2010
- Granted on 09/10/2010

Student visa: 09/10/2010 To 09/01/2011
- Submitted the visa application for Tier 1 – Post Study Work on 17/01/2011

I just got question regarding my wife's ILR.

Her spouse visa is expiring next month and she doest have much time to pass life in uk test and english laguage test.

Is there any way she can get extention meanwhile she passes her tests?

Your last student visa was expiring on 09/01/2011 and you applied on 17 th. That means 8 days overstay.
Not only that, your application was invali and you send another application on 15/02/2011.
Home office will consider gap from 09/01/2011 to 15/02/2011.
Previously it happened with some members in this forum.
Better to ask some experts or if you could order your SAR then do it quickly.

I fully agree with Sajjad Bahi, in fact I have to add another to the list I am afraid, if you see even your first visa was 1 day too late, expiring 31/10/2005 and applied 1 day late on 01/11/2005.
I am really sorry gurulay, but it is not looking good for you, you better see a good immigration advisor. I hope it helps.

I forget to mention that I applied the last student application in my country.
* I left UK on 09/01/2011 ( on the exact day when visa expired) and
* submitted the Post Study Work Permit in my country on 17/01/2011
* I still have the apology letter about 1 day late which i wrote to home office when I submitted the student visa application on 01/11/2005

can you please advice me is it ok or not.

I have received my Mrs BRP on the 18th and till date there is no sign of the BRP for my daughters, really cross, as I have to postpone their SET(M) PEO appointment for Friday. I have already emailed brpdelivery@homeoffice.gsi.gov.uk and called them but to no avail, they say wait for the reply to the email. Not happy at all after paying thousands that is the quality of service you get :(

I would highly recommend you write the same letter to UKBA seeking clarification. Once you receive a response, attach with your application. Your response will be tailored to you with your name and address and should aid your merit in front of a HO CW.

Hi All,

Just I am wondering if I can apply for ILR long residence under different visa categories as I have (3 years student visa + 3 years student dependant visa + 2 years Tier 2 work Visa + 6 months student dependant visa + 18 months Tier 2 work Visa dependant).

Or I have to under the same (one) visa category during the all 10 years.

Hi shahjee,

I don't understand if i am wrong correct me? Why do u need ur daughter brp for ur wife set(m) as i believe ur daughter will be eligible for MN1 the day u got ilr. where u need to write on dependant section set(m) that my daughter will be register for british citizen under section (1) (3) . So u don't need to wait for her BRP and also don't need to waste extra money for child.

So, my advise go ahead on friday. U will be ok.

Now that HO have started with the March Applications, I was wondering if the remaining Feb applicants ( Faisal, M.Elahi, Mbu001, Jageera420) heard anythng back from HO abt their application? I rang HO yday and was told it is still in process and not completed yet! :-(

I fully agree with Sajjad Bahi, in fact I have to add another to the list I am afraid, if you see even your first visa was 1 day too late, expiring 31/10/2005 and applied 1 day late on 01/11/2005.
I am really sorry gurulay, but it is not looking good for you, you better see a good immigration advisor. I hope it helps.

28 days out of date application is accepted by Home Office. But your gap from 09/01/2011 to 15/02/2011 is more than 28 days.
Why did you make fresh application instead of appeal? You have to make a good reason or case to justify your overstay period such as mitigating circumstances/sickness etc. It's not impossible at all so keep hope and speak to a good lawyer.

I have received my Mrs BRP on the 18th and till date there is no sign of the BRP for my daughters, really cross, as I have to postpone their SET(M) PEO appointment for Friday. I don't understand if i am wrong correct me? Why do u need ur daughter brp for ur wife set(m) as i believe ur daughter will be eligible for MN1 the day u got ilr. where u need to write on dependant section set(m) that my daughter will be register for british citizen under section (1) (3) . So u don't need to wait for her BRP and also don't need to waste extra money for child.

So, my advise go ahead on friday. U will be ok.
Only if she was born in UK!

Hi Chemist,

You don't have to be in the same category during all the 10 years.

As long as you don't have any gap between your previous applications, you haven't overstayed without any valid visa and your 10 years stay is legal you would be fine.

Also you shouldn't have left the country for 180 days at a time or 539 days in total.

sorry about that I forget to mention one case.
- I applied Post study work permit (after student visa expired on 09/01/2011) in my country
- I left UK on 09/01/2011 ( on the same date which visa expire 09/01/2011)
- Submitted the visa application for Tier 1 – Post Study Work on 17/01/2011
- Refuse on 28/01/2011 because of insufficient documents
- Make a fresh application on 15/02/2011
- Granted on 16/03/2011

I hope it's not count as overstay and my 10 years residency is not broken

It will not count as overstay and your long residency is not broken, as long as application was made within 28 days of expiry of current visa. I am more concerned about the gap you have between 09/01/2011 till 15/02/2011. Find very strong reason to defend your gap.
