Tier 2 General

Hi

I have done my masters from UK university and currently in 1st year PHD. I am a Dentist by profession and one of the Dental surgery has agreed me to sponser for Tier 2 general visa (the surgery hold a tier 2 license). I have 2 questions so if any one can help me or suggest me immigration lawyer or immigration specialist who can help me with application.
My questions are
1) The surgery agreed to give a 40,000 salary per year but they are telling me every month the salary will fluctuate depending on business (eg it can be 2500 in 1 month and next month it can be 4000) but they will see that at the end year they pay me above 40,000
Is it ok
2) Since i have done masters here am i exempt from doing a labour test (my profession do not come in shortage list)

If you have been on a tier 4 visa for the last 12 months then you are exempt from RLMT.

With regards to salary, I think you will have to agree on a minimum base salary with your employer and put that in the application form.
