Tricky Spouse Visa Question

Post by Remmington » Wed Jun 25, 2014 10:34 am

I hold dual UK and Swiss citizenship, and am engaged to become married. The difficulty is, my fiancé is a non EU national, and my work opportunities are in Belgium, Brussels. We both met during our studies, and so have not had permanent residence in the UK or anywhere else. Is it obligatory to be a citizen of Belgium to get married and acquire a Schengen visa for your non-EU spouse, or does my swiss citizenship act as a sufficient warrant to simply get married within the schengen area? Would I have to move back to the UK or CH for a few years before she is eligible to join me? Thank-you for any advice!

Since you are a EU and EAA national your spouse should be able to join you in Belgium with ease. Check info on EU/EAA family members.

The EU has a page on travel to the EU and migration aswell, covering rights of non EU family too (free visa, almost no documents required etc.).

The Freedom of Movement act, 2004/38/EC details your rights. Available in most languages (as PDF file):
