Five year period for ILR

Dear Forum Members

After a tiring fight with Home Office spread over one and a half year, finally, I managed to secure the HSMP visa today. I am now packing up my bags to leave for UK most probably next month. I was wondering if any member can let me know as to when the five year period for ILR gets started? Is it the visa date or the date of enrty in the UK? I will appreciate any response on this from the knowledgeable members of this forum.

Hi,

The 5 year period starts from the date of your landing in UK port of entry and not from the EC visa date. All the best.

Coz few days back I had written a similar query and got a reply from the forum member.

Hi,
Yes you can apply for ILR 28 days before your 5 year period but 2 conditions
1) The FLR shoould be valid on the date when the application is accepted by HO
2) If you submit your application before 28day before the expiry of your visa the application will be refused.

In case if you are short of a few days you have to apply for FLR and not ILR.If the applicant fulfills all the conditions then another 3 year FLR would be issued. The applicant can apply for ILR once he/she completes the 5 year period.

I am under 1+3 category. do you know will i get 1 year or 3 year FLR.

If you fullfill all the conditions then HO will issue further 3 years limited leave to remain.
