I am currently on tier 1 Dependant visa and planning to switch to tier 2 general. Sadly my husband can not extend his visa under Tier 1 Entrepreneur as he did not invest the 50K in the past 3 years and can not meet the other requirements either.
I have number of question and I hope you guys can help me!
Current situation:
-I've started my job 3 month ago.
-my current employer has certificate of sponsorship (A rated)
-my job and my salary are fine (NQF level 6 or above)
My employer said they perform RLMT for 28 days, and if they couldn't find a suitable candidate to replace me, they will ask for CoS.
now my question are:
-if my employer couldn't fine anyone, can I go back to my home country and apply for Tier 2 General?
-can my husband for dependant at the same time?
-should I (re)apply for my (current) job during the RLMT?
-what about interview process? should my current employer (re)interview me again for the position?
-what about my employment status? should I resign from my job before I go back to my home country to apply for visa?
I've heard some cases has been rejected because of appendix A paragraph 78 : (I am not satisfied that your sponsor has met the resident labour market test requirements as required by appendix A paragraph 78.)
do you have any advice to help me to avoid this kind of situations?
I am so confused and l hope you guys can help me.
