ILR application for child alone

Post by varghesejim » Tue Jun 24, 2014 12:57 pm

Hi All, Could you please answer the queries

Situation: Both parents got ILR(previously tier1). Child is still tier1(general) dependant. Child is not UK born.

1)Can child apply for ILR?
2)If yes, the Set(O) form have to be filled in whose perspective? I mean the form mainly asking for main applicant details. Should all the details of main applicant has to be filled in and just add the child like the same way if child was added with main applicant in for ILR application for both?

Thank you. This is a surprise. We were under an impression that it was Set(O).

We have booked an appointment for Set(F). We still have a doubt. In the gov website , the checking application says it is Set(O).

1)Should we fill up both the forms for appointments, just in case?
2) As our appointment is for Set(F), will they allow us to submit Set(O) if that is the right one?( Fee is the same)

Yes, they should be ok. SET(F) should be the correct form as both parents are settled, although SET(O) should be equally acceptable.

Just my experience.
My son's SET (F) premium service didn't work well, even though it was instructed by a solicitor.
Maybe I was unfortunate.
In the end, my son got ILR but it took a long time.
The whole premium service fee was refunded, and I had to send the application by post again.
Hope that you get your child's ILR in the same day. It should be.

If you are in doubt fill in both application forms, at the reception you can tell them about this confusion and they will help you out. When I was there I asked them this general question from the case worker (application was approved and I wanted to ask some questions, the receptionist called the case worker to come over to see me). They can even reschedule the appointment as we'll without you loosing your money.

the SET (F) form is a right form.
The HO didn't ask me to use a different form.

It would help if you explain why it took long for your application.

why set f

i really think it's set(o)

how long ago have you got ILR yourself? how old is the child?

your child's current category is PBS dependant

and on SET(O) one of the categories is PBS dependants

my daughter applied for settlement after me on set(o) and n oone ever doubted it was the right one

I really think set(f) is wrong, it is for those whose current leave is family based

We got settlement couple of weeks back. Child will be 2 this month.

Perhaps either forms should be acceptable. Since Set(F) asks for child's information in detail, that could be more helpful to caseworker.

Can anyone please suggest how to fill Set(O) only for a child as we would like to fill a form and keep it with us just in case. Should I fill the form in the child's perspective. Section 5(your home and finances) are difficult to fill then since the child don't work pay rent etc

If filling from the main applicant's perspective should I submit all the documents which I use for my ILR? The actual application is for the child , but only less details are asked for the child itself.Everything else if for the mail applicant.

When applying for only the child , who is the "applicant" in section 1?

ILR was successful.

Set(F) is the right form indeed. No questions asked.

As before, friendly staff and smooth process in Croydon PEO.

Hi varghesejim,
I am in similar situation as you. Could you please let me know what documents you submitted with Set-F application? Also is there any requirement for funds maintenance?

Regards,
kumar
