Apply for extension i April2015 and Ilr after July 2016
Applying is not the problem I guess. Problem is earning requirement. 65k it too high, i m struggling for 50k.
The earning criteria should really take into account economic conditions. It really difficult for a perm job with 45k+ pay. Only contracting is the way, but that too lot of competition.

Dear Friends and Gurus,

Good Morning ! Please could you guide me on my case?

1. I entered UK in Jul 2010 with 2 years Tier1 Visa , valid till Jul 2012.
2. Then extended my Tier1 Visa for another 3 years , valid till Jun 2015
3. As of today I have totally spent 170 days out of UK
4. My Spouse entered UK on March 2013 and on and off in UK due to personal reasons. Spouse visa is also valid till Jun 2015.
5. As UKBA has announced that there will be no extensions after April 2015, should I go for extension in April 2015 or as I am eligible for ILR in Jul 2015 should I do that ?
6. What would be the case to my spouse ?
Kindly let me know

Regards
Vijay

Hi,

I came to UK on 23rd April 2010 on Tier 2(ICT) visa. The visa stamp date is 8th April 2010.This visa was valid till 01/05/2012.

I then got a Tier 1 general visa valid from 4th august 2011 till 4th august 2013.

I then extended the tier 1 general visa from 1st June 2013 which is valid till 1st June 2016.

Now UK home office have said that they will not allow further extension of Tier 1 general Visa from 5th April 2015.
For my continuous stay in UK for 5 years I cannot use my stay under Tier 1 visa. I will have to use my stay under Tier2 ICT and Tier-1 general to make the 5 years continuous stay.

I wanted to check with you if my stay under Tier-2(ICT) visa will be considered or not as
In order for a Tier 2 (ICT) visa holder to qualify for ILR their first Tier 2 (ICT) visa should have been granted under the rules in place before 6 April 2010 and my Tier2 Visa stamp date was 8th April 2010.

Re: PBS status plz clarify

Post by Munazah » Tue Jun 17, 2014 6:44 pm

Dear all
I have been reading your post and have a very important question, my husband was in tier 1general and I came to the country on June 2013 as pbs dependant. My husband has got his ILR on June 2014, now I need to apply for my visa for extension. If I do it under pbs it will give me extension till 2017 but if the category itself is closing down what will be my status under that in 2017. Shall I be eligible for ilr or do you think I shall consider applying under FLR m for my extension.
Please reply urgently...
Thanks

Dear all
I have a concern, I came to the country on june2013 as pbs dependant my husband was on tier 1 general,
Now he got his ilr in June 2014 and I need to apply for my extension , if I do it under pbs I will get extension till 2017 which means I won't be eligible for ilr at that point and hence need an extension for another year but my concern is if tier1 extension is closing what will be my options .
I am also wondering if I should switch my category to FLR m now or should I continue my extension on pbs.
Please advise.

Dear all friends
I wish all to be positive..hear my one legal question for guidence and will be for uk home office also.
I hv tier1 general visa rom 2013 to feb 2016 under Hsmp judicial review of april 2008 and its document of 9 july 2008.
As now extension application is allowed till 2015 only.ok then what about cases like my case .
How I can apply before 2 years for extension?and if my 5 years not completed by 2018 then what. ?.no extensions? ???
Main point is as per hsmp judicial review document

clause 51. "Applicant can apply for further EXTENSIONS if they do not wish to apply gor sattlement."

It means applicant can apply more then one or many extensions...

Now one side court judgment says many extensions and now government says no extension.???

Now which statement to follow......

Plz consider and also reply if I m wrong as per legal published document statement.

Thanks and googluck to alll

Hi - I have the following question regarding the extension of my and my partner's Tier1 general visa. It would be really great to

I've got my Tier 1 visa in Sep/2010 but I've entered to uk in May/2011. The initial visa was granted for 2 yrs. The 1st extension happened in Aug/2012 for 3 years which is valid till Aug/2015. Due to visa extension restriction and my current job situation I would like to apply for the visa now.

1. is there a requirement for the applicant to be in job when applying for extension? I can meet the salary requirement (12 months in the last 15 months)

2. Will there be any problem when I'll apply for ILR in Jul/2016 as by that time I would be in uk for 5 year 1 month.

3. Does my wife has to apply in the same time as me for extension or she can apply later separately?

4. My wife has come to UK initially in Tier 2 general visa and then she has converted to Tier 1 general visa in Feb 2013. So will she be able to get the extension as Tier 1 general dependant even after Apr/2015. Will the time spent in UK as Tier 2 visa will be counted for 5 year continuous stay for her ILR?

Thanks. Please reply asap. I need to take some decisions early.

Thanks

@ssm4u,

I am exactly in the same situation as you are, my visa is expiring after Apr 2015 and I also want to apply for visa extension now using my current salary slips, because my job situation is changing.

My wife has also got valid visa which last even after Apr 2015 and I also want to know if she can apply later.

Any guru's that can help

Looks like you can apply anytime you want but the leave to remain will be granted from the date of application. Please let me know if you have any other information.

@ssm4u

I also think you can apply anytime before april 2015, but the extension will be granted from the date of application approved.

What I am not sure about is that does this new rule also affect your dependants. Do they have to apply at the same time as I am applying or they can apply afterwards clos to the actual time when there visa is expiring.

Unless a Judicial review is filed against this policy of closing T1G renewals, a very large number of applicants are going to get affected. If you want to support a Judicial Review against this policy, join http://www.facebook.com/groups/UKITF and show your financial support. We need a lot of people's support to even start opposing this unfair decision.

Since you are already on 170 days so I would recommend you not to move out of UK unless you don't get your ILR. Just to stay on safe side I would have done that. From your case, I don't think you need any further extension as you will be straight away qualified for your ILR in Jul 2015. Since Tier 1 General can apply ILR till april 2018 so it seems all good in your case.

However, in your wife's case, I don't think these rules will affect her visa as she's your dependent. So she should still be able to extend her visa. Read the posts and no where it mentions that dependent fall in for same rules too.

The only thing that needs to be confirmed here is Extension and ILR. Are these same terms when it comes about ILR as some people might think ILR is extension too. I believe Extension is meant to be done for 5 years period only. so if you are below 180 days you are all good to go for your ILR in jul 2015.

Can someone double check my opinion here?

Hi,

Please review below details and let me know if I need to extend my visa before April 2015.

I have received visa for 2 years from 14th March 2011 to 14th March 2013. But I had travelled to UK Dec, 2011 for the first time, hence I am eligible for PR in Dec, 2016.

I have extended my visa for 3 years from 14th March 2013 to 14th March 2016. This will not make me eligibale for PR, hence I was planning to extend my visa again for 2 years in March, 2016 and apply for PR in Dec, 2016.

With the new rules in place, can you please suggest if I need to extend my visa before April 2015?

Thanks
Suresh

Dear All,

I am planning to apply for Tier 1 (Gen) renewal in first week of April 2015. I am doing contracting with my Ltd. company and have a target of achieving 55K for the period I am showing. I am confident from the current stats that I would be able to make it but have one concern. I was on holiday in India for a month during May 2014 but still I was drawing Salary and Dividend from my company account. Can someone please advise if this out of country stay (30 days) will have any impact on my renewal visa when I am meeting the salary target?

Dear Friend,

I have same Visa but little different (my visa is under HSMP JR) but for you 30 days absence is no problem as per my study. you can find document on website which shows maximum continuous 180 days in year and overall 450 days in 5 years you can stay out of UK.

Hi Alex,

I checked the UKBA website and it says Tier 1 general extensions are till April 2015. Not sure where you got the 2014 date from :(
