I'm not sure what else you can do apart from complain to the Home Office, but I'm not sure how that is done (i'm sure there is something on google though).

If the chief caseworker (i guess it's linda) isn't budging, no-one else in her department will help you.

I replied to her email saying we sent all the required docs and finally she said she will get her colleague to review it based on that info. So, hopefully something might change.
Do you think not having the long COA has any impact on the decision of the application?

No impact at all. People who have got a short COA have still received the RC! Don't worry. The obvious problem is finding a job...

Hmm thanks chaoclive. I don't understand how some people get replies in a month or two. Ours has now been 4 months :( And its really frustrating especially when you need to travel. We are waiting everyday for the reply to come through the post...I just don't see how our application is any worse than any others :cry:

Don't worry - it will all work out in the end! Hang in there :)

I think it partly depends on the caseworker. Don't think about it, just get on with your lives as best you can and one day you will get a nice surprise in the post! Of course, at 6 months you should complain.

@Paggy: Yes, they did get the proper COA. Her husband has now received his RC also.

Hello again..

So my husband might be able to get a job through an agency. As far as I am aware (and by law) my husband has the right to work even with the wrong COA. Should he go ahead and go to interviews? If he can get a job, is there anything wrong with him working?

He can do as many jobs as he possibly can, no problem, absolutely legal.

according to eu law he can work .. residence card is not essential ..but it will be difficult as employers usually want to see right of work so they dont get fine.
You may have to fight a battle more than once to win it.

Please can someone advice. I am an unmarried partner of an eea national. I got a family permit last year december and we came into the UK in January 2014. I applied for the RC 1 week before my FP expired. I got a application recieved letter in 5 days and then i got COA in 2 weeks but states that they cannot confirm my right to work at this stage but i checked online and saw on UKBA Regulation 7(3) states that a person who is an extended family member and who has been issued with a residence card (or EEA family permit or registration certificate) shall be treated as a family member of an EEA national for so long as he continues to meet the definition of extended family member in Regulation 8 and the card (or permit or certificate) has not ceased to be valid or been revoked.

I have a job already and my employer accepted the application recieved letter from HO. Please advice what can i do?

@Samuel

If you read the above, you will see that the only way is to contact the Home Office (e.g. using the name/address of the caseworker on the COA that you received) and ask them to issue you with the 'long' COA. Otherwise, there's not much you can do.

Ok just got a confirmation from HO that I have been issued the short COA after calling them this morning. Reasons because they could not confirm my EEA sponsor exercising treaty right even after we sent all documents required.
The man over the phone has advised I write a letter about this.
@lunargirl i know you have been successful at this ,can anyone pls send me a draft of the letter they sent to the HO that got them to change the COA because I intend to do that ASAP

Today I received my Certificate of Application in the form of your letter to me, which is reproduced in whole and enclosed with this letter. I believe some of the information contained there (as highlighted) is incorrect. I hereby request that a corrected Certificate of Application be issued to me which contains corrections addressing the following issues.

It is clear that I have the right to work in the UK, by benefit of my spousal relationship to an EEA Citizen, <insert EEA's name>, who is relocated to the UK for purposes of exercising EU Treaty Rights under the applicable EU Directive as amended. Further, I have provided indisputable evidence of my spousal relationship with the EEA citizen in the form of our marriage certificate along with proof of our identifications in the form of my spouse's <insert EEA passport type (eg Irish)> passport plus my original <insert non EU passport type (eg USA)> passport.

Thank you Luna Girl, you are a star i am sure it will help so many people and it would be great if moderators could make such template as a stiker as i have read so many poeple struggling to get a template letter without success in the forum.
Also wonder why people with ROR always refuse to help others with template letter sent to HO :roll:

FINALLY, we received the right COA!!! :) Yay.. although they sent it after 4 months of waiting (and probably out of guilt because they sent us someone elses application! see link below) But nonetheless, at least we have it at last.. with two months of more waiting to go.
