Also, I am a bit confused about the extension I can apply for. My previous Tier 2 was for 3 years. And the employer has drafted a 2 year Tier 2 CoS number. Can it not be extended for another 3 years and before that I can apply for ILR?
if your initial T2G leave was under the rules after 5 April 2011 your stay under T2G is limited to 6 years, see para 192 in the guidance:

but of course your sponsor is free to assign the CoS for a shorter period

Thanks Manci. The initial CoS was for 3 years. My question is that, can I extend it for another 3 years, or will it just be 2 years. I am on an open ended contract so they would like me to obtain and ILR sooner rather than later... Now they've assigned the new extension CoS with 2 years on it. I have been told that the extension can only be for 2 years. The UKBA Guidance is confusing as well, in some places it says you can't stay on Tier 2 more than 6 years. And on other documents they say you can't stay more than 5 years and 15 days, etc. Wonder which of this is correct?thakur71 wrote:Hi,

Ok thanks - so it means it will only be 3+2 years and can't be 3+3 years for Tier 2?
