FLR M to SET(m) Query

Hi guys...

I have a question if anyone could please shed some light on...will be much appreciated

My wife has been here in uk on a tier4 student dependent visa from july 2008 to aug 2010.

then she went back to pakistan and in the mean time the visa ran out so we didnt apply due to some family circumstances.

She then got a dependent visa for PSW as i was issued with a PSW in mar2012 and she recieved her decision in August 2012.

She arrived in uk on 28 Nov 2012 and since then she has benn living with me as my dependant.

I have recently recieved my ILR on 10 years route and I am applying for her FLR m.

My question is ...How long she will have to wait for the settlement.

5 years before she can apply for ILR and it will be 2 X 2.5 year visas on FLR(M), meeting all the requirements at each stage, including the financial requirement and A1 English, before applying ILR on SET(M) and meeting the requirements again.

But the time she has already spent as PSW dependant .will that not count towards 5 years?

No, it will not as the rules changed on 6th April this year so if you applied for ILR on 10 years residence, your spouse has to switch to FLR(M) and it is now 5 year route to ILR, unless she meets all the requirements of 10 years residence on her own at some point, which she probably won't as she had a long absence.
