working tax no leave to remain

Hi

My husband originally came to the UK as a student, our application for a spouse visa was refused, we are now applying for flr(fp). However I just started work and applied for working tax credit. The claim came through the post as a joint claim, I am phoning to correct this. But I want to know if thia error will effect our application for flr(fp)?

I gather that your are settled/British?

Tax credits must be a joint claim if you are a couple.

Yes I am British.

I have put both our names on the claim but under my husband's name it states he is claiming working tax credits with me jointly as a couple. But he isn't entitled to any benefits so surely it shouldn't be joint?
