Just a quick question. I am applying for my ILR on the basis of 10 years. I married last year in Pakistan and my wife came over and her leave expires in December 2015 with my Tier 1 General stay. Can I apply for my visa only or do I have to apply for my wife as well at the same time. What will be her status and what would happen when her Leave expires in December 2015?

I would appreciate your response.

Nabeel
Hi Nabeel,
I have almost same situation as yours. For 10 years ILR you can only apply for yourself as there is no provision to include your dependents in 10 yrs ILR route. Once you get ILR, you need to apply for your wife visa extension through FLR M form. It is because once your status changes from Tier 1 migrant to settle person (ILR) your wife would no longer be a spouse of Tier 1 migrant and she has to get a new visa as a dependent of settled person by using the FLR M form and has to fulfill the requirements for the FLR M like financial 18.6K and English language test.

Hope it helps.
Thank you Arsal. So as soon as I get my ILR how much time I have to apply for my wife's FLR (M)? Alos, if I have my ILR due in August can I wait until February to apply for it or will it have a negative impact. I have to go attend family wedding in December. Hope you have some information on this.
Hello Nabeel,
You are required to switch your wife's visa from dependent of Tier 1, to dependent of ILR within 28 days of you getting your 10 yrs ILR.
As per payment yes of course you have to pay for the application FLR(M) when you apply.

hadu21 wrote:Dear Members,

I need advice about immigration case of my wife.

I was granted ILR on 14th April 2014 on 10 year Long Residence Basis. My 2 children (Born in London) have now acquired British Nationality and British Passports in July 2014.

I applied for my Wife's FLR (M) in Croydon PEO yesterday which was approved in 1 hour & visa granted.

My 2 kids and my wife were my dependents (Tier 1 General) since October 2011.

The approval letter we received at PEO croydon mentions that my wife has to wait for 2 years in order to apply for Settlement (ILR). However, I asked the caseworker that she has already been my dependent (wife) for more than two years and she replied that she can apply for ILR any-time suitable for us.

However, I know that rules have changed since 6 April 2014 which means that spouses have to wait for 5 years to get ILR.

I am really confused and dont know who to belive.

Can seniors of this forum help me understand the situation and guide me.

Regards
Hello hadu21,
The case worker has already told you to apply for your wife's ILR anytime you want. Since your wife has been your dependent for more than 2 yrs, she has already fulfilled the 2yrs rule. So if i were you i will just send in the ILR application for your wife. If you prefer to go to PEO thats even better and faster.

hi all,

i received my SAR from ukba on 16/07/14 but the information i wanted was not included as i only request for visa application records and they sent me a bundle of photocopies.on the very next day 17/07/14 i applied for another SAR with £10 cheque and ticked the box All data held by ukba, the question i want to ask is that will they comply with my second request like the first one or will hand the case to a senior case worker and he will start investigation as the second request could be treated as identical to the first one.

pls help,thanks

Hi spiderman,
Is your wife working? You the husband is only allowed 20 hours per week. You might want to look at FLR (FP) or FLR ( M ) for your wife. So far it appears there's a financial sections of both forms to be filled. Other members might be able to make inputs as per for the fact that you are not working at the moment.

We have today received the Biometric Card for my wife (FLR-M). They have granted the visa for exactly Three years. We applied on 17 / 7 / 2014 and new visa is valid until 17 / 7 / 2017.

This is not 2 years or 2.5 years ...

What do you think about this?

Hello All

I had applied for my wife's FLR M on 03 April 2014 while my ILR on 10 years basis were being considered. I have received my ILR recently and just received my wife's FLR M passport, documents and home office letter back.
It does not say anything about approved or reject but I assume it is approved because there is no rejection letter. In the home office letter it says you can apply ILR after 2 years but I believe these are standard letters to every one for just guidance. I have phoned to DX courier to find out if there is any delivery for us and they said no.

What do u thing Is it approved and if so how long is the visa?
We are desperately praying for 2 years visa as my wife was pre july 2012 pbs dependant and we applied before 6 april 2014 before fm appendix kicks in.

Please guide

I think all the information you need is in the application form and guidance as well . Just settle down and read it carefully, it is not complicated, you can do it. I understand that you are full of excitement about your ILR approval.
Hope this helps.

Hi Guys,

I would like to share timeline about my case and I need help on my wife's (FLR M).

Alhumdulillah my approval letter for ILR application was issued on 04th July 2014, it took nearly 4 months to complete the process.

Case submitted on 8th March 2014
Acknowledgement on 19th March 2014
Biometric done on 21st March 2014
Approval and documents received on 4th July 2014.
Didn't receive my card in next 7 - 10 working days. ( I emailed them on 17th July 2014 and card received on 21st July 2014)

I would like to know about FLR M, my wife came to uk on 18th Feb 2011. Do i need to fill the financial requirement or just maintenance.

Could someone please share some information on this issue or guide me what information I need to provide in the form.
Can I go for one day service ? how much the fee will be ?

I will be very thankful to you guys.

Thanks.
