Hi guys

Just to give you all an update on out situation. Our ILR was refused because the HO said we hadn't met the English test requirements. Be careful those who are using IELTS certificates.

The settlement checking service and our MP are backing us in applying for re-consideration for two reasons.
1) on the day we applied the HO told the settlement checking service our IELTS certificate was acceptable.
2) we also included a City and Guilds B1 pass certificate from the approved list, that no ones had looked at for some reason?

Here is hoping that firstly they look at it then they overturn it.

Hello All,

Long time reader.

I just wanted to say that this forum has been a great source of encouragement during the difficult process of waiting for the UKVI to get there figure out.

We applied for my wife's ILR with the following timeline

April 5th 2014 - documents sent
April 23th 2014 - Biometric letter
April 30th 2014 - Biometric test
31st July 2014 - ILR granted sent to Lawyer

Note that we had to expedite the request as my mother in law passed away on the 27th July.

Things to note:

1) When we expedited I got in contact with my MP who supported our application. As a result the UKVI took 3 days to process and send the ILR. This was really frustrating as we had to obtain proof of death from the hospital where my mother in law passed away, but also because it showed how quickly they can process applications when under pressure.
2) My wife did the Trinity College English test. This is easy if you practice the role plays (she got 27 out of 30)
3) Read the book for life in the UK testing- this is recommended and it will help you pass. I find it quite offensive that this test only applies and as a British citizen I could not pass this exam.
4) We had a lawyer - you don't need one. If you have a child- submit letters under there name as well (if these are at the same address) and the red book etc

next steps- I have submitted freedom of information acts to the home office requesting stats for ILR for March and April 2014. I plan to write a letter to my MP and request that the staffing and turn over time of settlement applications be reviewed.

I am absolutely disgusted that we pay over £1000 for a service and yet have to wait 6 months + for a response.

Any questions please let me know,

Best

Ajay

Hi All! Finally, last friday received approval letter! Timescales:

27.03.14 Applied via Checking Service
01.04.14 HO received my application (based on the info they have provided)
07.04.14 Letter from HO acknowledging the receipt
17.04.14 Biometrics enrolled
01.08.14 Decision Letter
...waiting for RBP

Please note that I was trying to expedite the process from mid July and received correspondence with a "no"- not enough evidence (took week and a half). Just briefly there is a war in my country, which broke out suddenly and I need to go see my mom, who is elderly, very worried and needs support. Thanks God in other ways she is all right. What evidence can I provide when it is obvious and all over the news? So it looks like the system just needs for someone to already to be killed to be sufficient for a travel. Very sad. I can't complain now as I have got the decision and just need to wait for a permit to arrive so I can travel. I don't know if someone was sympathetic at the HO to my situation (I would like to believe so) or just my turn in the queue has come.

All the best to the ones who still waiting and thanks very much for the forum, which was a great help and support!

PS. Just advice based on my experience - use Same Day Service even if you don't foresee any travel at the moment of applying. It worth all the extra £ and will save you a lot of nerves. When it came to it and I was desperate to travel I was ready to withdraw my application and apply at the Same Day one, but apparently you cannot do that. Hope that helps.

Congratulations, you must be so happy after all this stressful months you spent. So from your story we can say HO can delay ur application if they want. Doesn't matter if you go for postal or PEO service. Anyway you got a good news at the end. It was worth waiting.

IELTS results were as follows:
Listening :4.5
Reading :5
writing :0 (didn't appempt as home office said not to as it wasn't needed)
speaking :5

Overall score 3.5

They are now saying you need a 4 or higher on everything and a 4 or higher as an overall score. The day we applied they said you only needed a 4 is speaking and listening the others and overall score didn't matter.

What did they say to you? If they said the same we have evidence to support each other's applications.

The frustrating thing is if we hadn't have been told not to bother with writing he would have done it!

Our MP says that with her help our case will be reviewed in 10 days. The settlement checking service have given a statement that on the day we applied the home office told them our scores were fine and therefore they told us to submit the application. We also have a copy of the check list they used, clearly showing the home office logo and showing English pass was ticked!

I hope all of you guys have an easier journey than us.
