8 days short to qualify for ILR- Long Residency (10 Year)

Hi,

- I came in the UK 19th Nov 2004.
- Currently on Tier-1 (General) which expires on 13 Oct 2014.
- i am short of 8 days for the qualifying period which is 28 days prior to application and that makes total of 36 Days altogether.

can i apply for ILR on these basis.?

or

do i need to apply in some other category and then switch the application to ILR.

Please advise what are my options... ?

Vary your application by putting FLRO or FLR FP and on the 28th day send your SET LR application with covering letter and fee difference. I have done the same I was short of 6 days. got ILR last week.
Flro applied 23.02.14
Varied application to SET LR 3.3.14
Biometrics done 24.3.14
Approval 24.7.14
Docs received 28.7,14

Thanks mate.

I have 3 dependents.
my wife and 2 UK born children 5 & 6 years 10 months their Visa are also expiring so should i inculde them in my FLR-O application as well...? so that they don't become illegal. i know my kids are fine once i get ILR, but not sure abt my wife..?

please advice..

HI, I sent my wifes application with mines, leaving my sons out, her application is still in process. its 2 weeks since my decision came out.
Flro applied 23.02.14
Varied application to SET LR 3.3.14
Biometrics done 24.3.14

So you mean sent her application as FLR-O as well then Vary her application too like mine, but hers going to be ILR-M form..??

HO returned form and asked to apply as FLR FP, which we did back in march
Flro applied 23.02.14

Don't make FLR O application NO NO NO

Submit FLR FP form. Correct form for private and family life.

Basis should be your private life and article 8.

U don't want FLR FP visa do u ?

U just want to complete 10 years which is 8 days short

I was short of 10 months and submitted flr fp , refused in 2 months and now in appeal hearing.

So just apply flr fp and than vary it to Set lr.

Tricky part for u is your children application. It's upto u if u want to include them in initial flr fp or not.

As they will register british once u get ILR. But thing is if u don't add them HO may ask u why u didn't include them (happened with few people here in this forum).

So it's better if u hire a solicitor.

Once u complete full 10 years vary your application to set lr and your wife to flr m.

Hello, if i may advice, what ever you decide to apply for (flo or flfp) , please pay the full fee when varying to Ilr, to avoid case worker mistake which might lead to invalidity (talking from personal experience)
If you can afford it, you should probably include your children I believe it may strengthen your application.

If you pay the full fee, they should refund the initial fee that you paid.

Hi All,

I made FLR (O) application on the 13th Oct 2014 on my Visa expiry date by post and then varied the application to SET (LR) on the 28th Oct 2014. Biometrics done and waiting for the decision. :) insha Allah hoping for the best result..

Thanks Favour, i paid the full fees on both the application and have requested for the refund of FLR-O Application as well while varing to SET-LR.

Update:
I got the letter from Home Office on 20Th Dec 2014 confirming my application for FLR-O has been varied to SET-LR and they will issue me a refund soon for my FLR-O application. But they sent my passports and my wife's passports too which was a bit confusing as Passports should have been forwarded to the case worker for my SET-LR & my wife's FLR-M application. bit confused...

Hi Addy582, what did you say in your cover letter when you submitted the variation? I'll also be submitting a variation later this week and wondering what information has to be included in the letter of variation for it to be accepted.

Hi Blackstar,

i just included my current application Home Office reference number and asked them to vary it to SET-LR (in my case) with my full name, address and DOB.
