ILR Main applicant and dependant form query

Post by Skc84 » Fri Aug 08, 2014 6:47 pm

Hi Guys,

My friend is applying for ILR and would like to know which forms need to be used for dependant wife.

Main applicant: Tier 2 (G) to ILR = SET (O) form

Married May 2012

Wife: Came to UK on TIER 5 visa in June 2012 after marriage. (Holds Australian PP)
Switched to Tier 2 dependant in November 2013 and currently on it. (Application was out country but was only away for 3 weeks)

Which form she should be using? And can application be made together for same day service at Croydon?

Both visas run out same day as it's main applicant and dependant on Tier 2.

Appreciate your feedback as soon as possible.

Thanks Amber that means for wife's application it needs to be considered from Nov 2103 as T2 dependant rather than Tier 5 entry in june 2012. right?

Also can application be made together for same day service at Croydon under 1 appointment?

And if its postal can it be sent same time as both visas run out same day and husband has not got ILR yet.
So husband sends ILR Set (0) and wife Tier 1,2,5 PBS dependant?

Also which option should wife tick as husband has been on T2 (G) for 5 years, and wife moved to dependant last november 2013.

Tier 2 General, ICT Long Term Staff – over 3 years leave to remain
Tier 2 General, ICT Long Term Staff, Sport & MOR - up to 3 years leave to
remain

Please let me know
Thanks

She'd need up to 3 years leave to equate to 5, wouldn't she?

Thanks Amber,

Yes thats right. But are we counting the time from Tier 2 (dependent) that is Nov 2013 or when she was on Tier 5 from june 2012 until nov 2013?

Can you confirm this can be done? As husband has not been granted ILR yet
Applying Jointly;
ILR(Post)=£1051
PBS Dependent(Post)=£953
Total =£2004

So select this option if using PBS dependant?
Tier 2 General, ICT Long Term Staff, Sport & MOR - up to 3 years leave to remain

What is this option?
Tier 2 General, ICT Long Term Staff – over 3 years leave to remain

Not sure which one to tick, give the contact centre a ring and ask.

Thanks Amber. I will check with center

Can you confirm the below forms can be submitted as follows by post? As husband has not been granted ILR yet ( T2 to ILR yet) and both theirs visa's expire same day. so she can submit her application (pbs dependent) with his as his ILR will be in process.

Apply Jointly by POST;
ILR(Post)=£1051
PBS Dependent(Post)=£953

Or she needs to wait for him to get his ILR which wont help as it will be postal application and by then her visa will be out too.

Please let me know..thanks again

To the addresses on the application, include a cover letter with the PBS dep extension application.

Thanks Amber. There is a question in the PBS dependant form for dependant wife.
Wht should the wife tick? As husband is applying for tier 2 general to ILR set O same time by post as separate application

Wht should be the answer for M1 to M4? (PBS dependant form for dependant wife)

Section M - About your Maintenance

M1; Are you applying for leave at the same time as the PBS main applicant that you are dependant upon?
Yes go to M2 No go to M4

M2; Under which category of the Points Based System is the main applicant applying?

M3; Is the PBS main applicant making:

M4; Has the PBS main applicant received notification that their application has been successful? (ht)
