Hello all,
By the Grace of Almighty Allah, I have received my approval letter with passports [Shahgee1234 (elder brother) already announced the great news].
The last 18 months were tough as initially I made Tier 1 application in February 2013 which was refused in April and appeal was made in time. But Home Office withdraw the original decision a day before the appeal hearing in September. I waited from September till march this year but got no reply and then I varied my application to ILR on 31st March 2014 as I was eligible to apply under long residence category.

My timeline is as follows

Set (LR) Application sent: 31/03/2014
Acknowledgment: 05/04/2014
Biometric invitation :14/04/2014
Biometric enrol:14/04/2014
Approval: 12/08/2014
BRP received: waiting

Thanks everyone and good luck to all who are waiting.

Hi Sanju ,

Congratulation on the approval of your wife ILR , don't worry your will be arrive very soon as well .....so its seems both of you completed 10 years together ? ...can you plzz share some thing about your case ? how did u apply ? who was the main applicant through out the 10 years ?

Thanks

S.Akaram

Hi s akaram,

Yes we did complete 10 years together. And I was the main applicant all the way. We came here as student then got married. I was on student visa+igs+psw+tier 1 general. I had one refusal for igs took 15 months but eventually won the appeal. Other than that my case is straight forward. We missed my wife's Brp delivery today, got to rearrange it.

Regard's,

Sanju

Just to clarify if I understood correctly, sending my ILR application now will have no effect on my wife's situation (being my Tier-2 dependent). She would still be able to apply in Nov 2014 (i.e. when she completes her 10 years) ?

Kind regards,
Timmoo

Oh dear..I'd want someone with better knowledge on this to answer.....

However, from the little I know,it shouldn't affect your wife's situation.
Babz is right. You should apply for your ILR and it will not have any effect on your wife's situation. Its an individual application for yourself. Apply for her ILR when she is eligible in Nov.
Dear Aurnoc,
Thanks a lot for the helpful reply.

Mrs. p
i think you fed up from your solicitor and want to pursue your case at your own? i think when you call them then also ask them that have they changed your address on your request or some other procedure you need to use to change address?

And also they have mentioned pbs in rules and tier 4 is also PBS so I am confident that she will get ILR as HO have given her 2 years visa otherwise she would have given 2.5

Hi I'm new to this forum I I don't understand it totally. But if anyone could give me some help it would be much appreciated. My husband just applied for ilr on form set m we applied on the 7th of August at a premium service appointment. We were denied ilr but awarded flr as they said the English language requirement was not met as they had changed their rules on the 1st of August meaning they had changed the type of test and providers that are now acceptable. My husband was awarded a ESOL English life and skills certificate by trinity college in which he achieved a higher level than b1 he's test was taken in March. The lady that refused our ilr said it was to no fault of our own. I found this very unfair as they only put up this information on their website after our appointment. Can anyone give me advice or has anyone had simular experience. All other documents where in check.

This is the time for you stay positive, now let me tell you a good news my brother is also on this forum khan_81, he also applied on the 30th March, the same day that your husband applied. The only difference is that he provided Home Office with self addressed special delivery envelope which is next day delivery. Although I should have waited for him to break the news to the forum, but as you are worried I have to let you know that by the Grace of Almighty Allah, he has received his approval today. So I would presume that as your husband also applied on the same day as his, than your husband is also a good news. So stay positive and give us the good news ... Hopefully today or tomorrow than. My prayers and best wishes with you.
Kind regards

Lol, Cool mind, they were asking me for more money to reply to the caseworker letter, I said I can do it myself and that's why I filled in the online form to change my address, I will call tomorrow and confirm if they have changed the address in their system, it says 72 hours on the online form. Let's see, I will update tomorrow.

Hi ik_aam_insaan and Miangee,
Thanks for your feedback ik_aam_insaan. Miangee you need to be confident and as ik_aam_insaan advised please follow that, I hope you get the good result.
When I applied for my wife and daughters at the PEO Croydon, the only question which they asked us was are they PBS dependent, I replied yes they are. And after that no questions asked. So be confident, and hope for the best. My prayers and best wishes with you and your Mrs.

Hi Ummali01,
Leaving your main question aside please, I have a few questions regards to you case, if you don't mind sharing the whole story with us. As looking at the facts of the case I am a bit baffled. My questions are
1. When did your husband received his FLR(M) ?
You applied SET(M) on the 7th of August, so I would presume the FLR(M) should have been issued before that, isn't it ?
2. Why would Home office issue another FLR(M) on the 7th of August, when your husband already have an FLR(M) and was just trying to apply for SET(M)?
If you are going to answer that no your husband didn't have any FLR(M) before this SET(M) application on the 7th of August, than I would suggest that your husband applying for SET(M)application was wrong. How could he apply for SET(M) before he gets FLR(M) ?
From 6th of April 2014, rules are quite clear, dependent of a settled person have to apply for FLR(M) first, and than spend a qualifying period for 5 years to qualify for SET(M)
And just in case if your husband already have FLR(M) than why would they give him another FLR(M) visa.
Really sorry but your husband's case is not adding up, so we would appreciate if you can give us some more details of how, and why did you guys reached the conclusion that your husband is eligible for ILR through SET(M)?
Many thanks.
Kind regards

Hi tanz5656,
I applied for my Mrs on the 3rd of April, and I got my ILR on 12th of June. They got their FLR(M) decided just 4 days after that on 16th of June, and we received their documents on the 17th of June, and I didn't wrote any letter asking them to start the process again on their application. So I would say it depends on case to case. All the best.
Kind regards
