Spouse Visa for Settled on Long Residency Urgent Help!

Post by Kvakas » Wed Aug 13, 2014 12:57 am

Hi,
Please help
I was on Tier2 got ILR on Long Residency Aug 2014
Now wife has Tier2 Dependent Visa Valid until 2017 she got first entry clearance before 9th July 2012 as PBS dependent and living with me in UK since Oct 2012.

Does my wife need to apply FLR (M) ASAP?
What is going to be her route to settlement 2 year or 5 year?
She satisfied English language in her first time application ETS Esol which is not accepted any more by Home office , can we still claim that?

Please answer ASAP to solve the issue .

She must apply for FLR(M) under Appendix FM before current leave expires, a1 English required, a test must be approved as per https://www.gov.uk/government/uploads/s ... _07_14.pdf

There is also a Financial Requirement and it's a 5 year route to settlement.

Even her English ETS ESOL test was accepted at first initial application , still she needs to do it again??

Still you think Certificate of English language is not valid.
i have quoted from policy guidance on Appendix FM

"Otherwise, where the applicant already has a test certificate or result from a
provider who is no longer approved, or in respect of a test which is no longer
approved, we will accept that certificate or result as valid if its award to the
applicant has not been withdrawn by the provider and the Home Office has
accepted it as part of a successful previous partner or parent application (but
not where the application was refused, even if on grounds other than the
English language requirement). "

I would err on the side of caution.
