We received COA letter yesterday dated last week. They are advising us not to call them or ask anything next 6 months.

Hi All,

I'm going to apply for permanent residence end of this month after 5 years completion of marriage in Uk. my situation is

married in july 2009 and got 1 years family members stamp on fmrs
september 2010 got residence card for five years expiring 2015
April 2013 divorce and got retaining the rights of residence 5 years card on october 2013 expiring 2018
now my 5 years from marriage completed including before the divorce period. i have following documents:
1- my non-eea passport
2- my 5 years P60
3- my council tax documents and tenancy agreement for 2014
4- my employer letter confirming my employment
5- my 3 latest payslips
6- my contract of employment
7- my ex's three years tax document photo copies (provide for retaining for residence card)
8- me and my ex's three years joint account bank statements
9- divorce letter from county court

are all these documents are sufficient. i am going to write home office a short cover letter as well. Can please anyone give me any suggestions. is there any other document that i need to include in my file. And last thing, anyone kindly update the current processing time as well.

EEA4 Application Sent: 21/07/2014
Application received by Durham HO: 22/07/2014
EEA4 fee(£55) taken from credit card: 24/07/2014
Reference letter received: 28/7/2014

It should be a straight forward application, I've been in the country for over 5 years. Worked for the same company in this period.
Documents Provided:
1. Marriage certificate.
2. P60's all 5 years for applicant. (Myself)
3. P60/ Self Assessments / and other work docs send for spouse for 5 years. - German Nationality EEA
4. 5 years proof of residence (Utility Bills / Council Tax)
5. Passports for both Applicant (myself) and Spouse.

Waiting for COA and then the PR. :) , Hoping to get it soon.

Hi ,

No Covering Letter, Dont think there was any thing to get confused about. The docs are clearly marked , and not really anything to get confused about.
I see other people advised a covering letter. Not sure if it makes anything quicker. Time will tell...

I think you're very right . I had submitted mine with no covering letter too, and later saw people here mentioned of a covering letter, and I was later thinking if I should had put one :) with positive mind all is well for now

i send my EEA4 on the 26/06/14 (received by HO 27/06 in durham). payments taken 30/06 (credit card), confirmation letter received 03/07 (dated 30/06),
COA received 12/07 (dated 07/07)
been separated from my EEA wife for the last 2 years, divorce absolute issue on 05/14
My RC is still Valid till 08/15 still valid for one year, but been married to EEA over 5years as qualify for PR after 5 years from the date of marriage
the wife was agreed to provide me with the required documents.
the documents i sent as the following...

EEA national
P60,P45,Payslip all together for the past 5 years
Bills
Voters Card
Tenancy agreement in both our names while living together
......................................
ME non EEA
passport
P60,P45,Payslip,university letter and currently a student studying masters degree all together for the past 5 years

Comprehensive Sickness Insurance due to I'm currently studying
Bills showing same address as my ex-partner when living together

i have a question as i sent my doc both EEA3
And EEA4 on 10 April i got COA money taken. but no reply yet near 4 monthes now. i havent heard from them at All. and i never phoned them ..
please any advice or suggestion please?

Hi , I suggest you should call them to find out what going on, just because under law the EEA3 application for EU Citizen shouldn't take up to 6 Months to reach a decision, their own application should be treat as urgent different to that of non-EEA member of EEA4

thanx alot for ur reply Nico. but i read here the HO say dont phone untill 6 mothes pass..i dont know why they havent worked on my application as they do it in between 4 .8 weeks max.

Well, my first application took them 5.5 months. Re-submitted March, got PR in May.
Your is not too bad yet! have some patience, really :)

I suggest Stoli is a bit right there. You can decide to wait a bit before calling them though, is up to you.

Just an update regarding my application.

EEA3-EEA4 based on self employment and employment posted on 16/07/2014
Reference Letter for both received on 22/07/2014 dated 18/07
Coa with permission to work for eea4 received on 04/08/2014 dated 29/07/2014
For eea3 no coa but only email received confirming the fee deductions and that application is passed onto case worker.

Hi Kkuk,

I suggest the email is ok your EEA3 as approval for right to work here doesn't apply to EEA Nationals

Request for passport to travel on the 06/08 for urgent travel, passport received in a week 13/08 with out PR issue.

A letter attached saying non EEA wishing to travel aboard should apply for an EEA family permit at a british diplomatic post aboard before returning to the Uk, as it free of charge and on priority basis. It should be noted that any such application would need to be supported by evidence to show that EEA national is in the Uk, is exercising treaty right, and that the relationship is as claimed. Please do not return your passport to the HO until it been requested by a Caseworker.

However, I still have one year valid left on my RC, please can anyone here advise if I don't need to apply for the permit at the british diplomatic aboard to return, can I used my RC still valid for one year to return in the Uk, or decide not to even go aboard at all, can anyone confirm that the letter is written to me by my caseworker as there is a name on the letter and a contact number on it which is very unlikely of them ?

I'm going for the purpose of collecting data abroad for my research, in which I'm looking for the possibility to do that over the phone and internet based.

Can you please advise of what might suit best in my situation ? I will look forward to you guys advise

Hi Nico,

You can't really use your Residence Card. Your Residence Card was conditioned to the fact that you were a family member of an EEA national exercising Treaty Rights in the UK. This is not the case anymore, since you have divorced your EEA national on 05/14. Hopefully the HO will be sensible enough to process your EEA4 request without a hiccup, since this looks like a straightforward retention of rights case.

Regarding travel arrangements, if you are a VISA national, I'd personally postpone any trips until you have sorted this out. It shouldn't take much longer and you may be hassled in the border by an ill-informed agent.
