Tier 2 cooling off period

Hello,

A colleague received a Tier 2 ICT visa and was supposed to come to UK in September. However due to family circumstances she needs to postpone the visit. Looks like it may only happen after the current visa will expire. Will the cooling period rule apply to her case considering she will not getting into the country under the present visa, but will reapply for the new one in three months?

Also any legal grounds to change the dates in the current visa or apply for discount on reapplying?

If they never travelled they are not subject to the 'cooling off' period.

Thanks. Trying to call the consular service and/or HO to clarify whether we entitle to discount or need to reapply and pay the full price once again. Found something about "making changes in your visa", but looks like this is about mistakes only. Any ideas?

Needs to be a fresh application with full payment of full fees.
