Short of 5 months 7 days for my 10 years

Post by jibri » Thu Aug 14, 2014 2:55 pm

Hi
I am currently on Tier 2 General. My extension in next few months but it seems to be difficult because of my salary. At the end of my tier 2 visa I will short of 5 months and 7 days only for my 10 years. Any suggestions please?

Thanks in advance.

Well if you apply and it is refused, then you will have a right of appeal, and this will count towards your 10 years lawful residence.

If the appeal is refused, you could then make a 10 years application, under the long residency provision. If they take longer than 5 months and 7 days to make a decision, you could vary the application, to ILR.

It all depends on which area in the UK you live.

Hi
Thanks for your input friends. I think that's one option. What if I try to get my Tier 2 extend. What salary requirements are for extension ?

How long have you been with your employer and is he still prepared to sponsor you?

You have other options if that fail.

Provided you can obtain 50 point for attributes from Paragraph 76-79 of appendix A , you should be able to obtain an extension.

Thanks Obie for you help. yes the sponsor is willing to continue only issue we are having is salary as I think they are not willing to increase to that level. Will i need salary as experienced to get extension? what other options are that's where the confusion is since I am willing to continue my employment with them and if any other option leaving this job before ILR will not be in my favour

I think the best advice were given, which is to apply for FLR FP before your visa expire. This will give you right of appeal and you can appeal within 10 days of the appeal. You will be given at least a date beyond your 10 years. Appeal process can take long...

You can continue to work while all these process are going on...

All the best.
Great

Thanks All

Can I continue to work with my sponsor if I apply for another type of visa?
