British Citizenship

Post by kpk1234 » Mon Aug 18, 2014 11:33 am

Hi,

I have recently been granted ILR and my wife is British Citizen by birth and we are married in 2012. Am I eligible to apply for British Citizenship based on the following link or do I have to be on ILR for 12 months? My ILR is based on Tier 1 (General)

https://www.gov.uk/becoming-a-british-c ... sh-citizen

Thanks for your help in Advance.

Regards,

kpk

As you are applying on the basis of your wife's British citizenship & going by that link.. ILR period doesnt apply to u..like how it does for main applicants.... only criteria they are saying is u should have stayed in country for 3 yrs.. in your case which you are anyway.. Also that 3 yrs is not marriage period.. You are fine..just make sure ..on the day of application if you were in country 3 yrs ago..

Many Thanks for you replies IndiMarshall and ban.s

Just one more clarification.

If I apply today(18/08/2014) and home office received the application on 19/08/2014. I should have been in UK on 19/08/2011. Is that correct? What happens if I am outside UK on holiday?

Logically the date you post them matters I think.. not the date they receive as there might be delays sometimes .. check with others .. I am not sure..

For nationality applications, the application date is when the Home Office receives the application.

Thanks again IndiMarshall

Thanks Vinny

Vinny can you clarify based on my example? Do I have to be present in UK on 19/08/2011? Or Is it OK if I had valid visa at that time and I was away on Holiday abroad.

Many Thanks,

kpk

You should have been present in the UK at the start of your qualifying period (3(a)).
