Switching from Tier 1 General to ? <best option>

Post by O_Relly » Wed Aug 13, 2014 10:03 pm

Hi all,

My wife is unable to extend her Tier 1 General Visa, due to an extended maternity break, which is due to expire this October. She will have completed 3.9 years in the UK in October.

Her options now,
Option 1: In-country switching to Tier 2 General (Employer Sponsored) Visa.
Advantage here is continued residency towards her ILR.

Option 2: In-country switching to Tier 1 General Dependant (I am on a Tier 1 General Visa)
Her ILR clock will be reset.

Option 3: Apply for EC as a Tier 1 General Dependant from home country.
Cheaper than Option 2, but ILR clock will be reset.

Now I have 2 questions,
1. Does Option 2 have any advantage over Option 3 ? as in both cases, her ILR clock will get reset, so really should be no difference between the two?

2. Is my understanding of Option 1, being the only viable option for continued residency towards ILR correct?
Note: Tier 1 (Investor, Entrepreneur, Exceptional Talent) are not an option. Tier 4 for study is not an option as well. She might choose to study later on, but that will be possible through Option 2 / Option 3.

Thanks very much for your time, and valuable advise.

The situation is clear, I was needing confirmation if my interpretation was correct.

Let me know which bits you didnt understand and I can try and clarify.
