They gave a job offer on the basis of my previous master's degree in engineering. At the moment I am doing my PhD and I am on student visa (stamp 2). When I start working full time, I would like to complete my PhD part time. The company applied for a Green Card and it was rejected since I am on stamp 2.
a] Does this mean that in order to get a green card, I have to apply for it at the Irish embassy in my home country ?
b] Would a work permit be a safer option for me instead ? How long would it take to get a work permit if my company is willing to apply for it.

i think you might have sent me a private message in easyexpat, so i will answer you question here instead of replying to the other website. the dept enterprise is talking cxxx here. you stamp 2 is giving by the dept justice not by the dept enterprise. anyway, if the dept enterprise rejected your application for green card now. no point to apply to it again because they already have you in record. it is very likely that they will reject you again if you submit a new application. i think you have couple things you can check out now. first of all phone the green card help line and ask them what is the story with your application. as far as i can see in the guildline published in the dept enterprise website. it only said that you only need to have a job offer for 2 years and required qualification. it never said you have to be outside ireland. from you post here. you have a master degree in engineering. you have a job offer from your employer. so you phone them up and ask them if they rejected you because you have a stamp 2, just ask them when can you apply again. ask them if you have to finish you phd or not, if they tell you that you have to finish your phd before you apply again. this is rubbish. but do phone them up and ask what can you do from now on since they have all the bloody discreetionary power over the poor legal migrant for no reason. if they still say no to you. the only option you have left is ask you employer to apply for a work permit for you and see if they going to reject you again in the same ground which i hope it wont happen to you. if they give you a work permit, you can always apply for the green card again. so good luck but whatever they told you about the stamp 2. it is just rubbish and they dont know what they talking about because dept of enterprise has no authority to say what stamp you getting from dept justice!
