Hi members,

I have asked this question before and haven't got a precise answer.

I will NOT be sending in any bank statements or utility bills because I have all previous passports. Do I still have to fill in Section 5 page 22 and 23 of SET(LR) form ?

I'm sending my application in the next few days. I have signed page 22 (in case) and left page 23 blank. I have provided all passports covering last 10 years.

I've gotten this far, I don't want a simple point putting off a (possibly junior!) CW into checking and delaying my application.

That is a good idea, I will do the same. you can't be penalised for signing it.

Hi fielddrive and 12years,
I would say to sign page 22 even if you are not providing bank statements and utility bills, and leave 23 blank.
That is exactly what I did, and so many of my friends who have already got their ILRs. I agree fully with fielddrive, you guys don't want to take chances, just in case an inexperienced case worker gets the file and creat an issue of it.

I agree with shahjee that sign 22 but leave blank 23 but also sign 24.
Shahjee, what's your view and is following correct:
So means that given the scenario a person himself applying and using own home address for correspondence then simply ignore A3 and write current home address at A2 and B14 and ignore B19.

shahjee is correct. it is mentioned at least twice (once in guidance and another time at the end of them forms) to include photocopies

And MartaNK, I understand and all of us have gone through this stage of not sure about things before we applied, but I would suggest to be regular on the forum and top up your knowledge regards to what are the immigration rules applicable to your case, and cover all bases, and trust me you will be more confident and you will sail smoothly.

Hi M2013,
What matters is the date you arrived in this country, so in your case you will complete 10 years in this country on the 17th April 2015. You can apply 28 days early, hence you can apply on or after the 20th of March 2015. I hope it helps.

Hi Nikki,
I fully agree with Fielddrive, I would suggest the same, especially knowing that your present employer can creat trouble for you. Best is that status quo should prevail, till you get your ILR. Although you have already spend your 10 years legally, and there should be no issues, but it's better to avoid confrontation with your present employer. I hope it helps.

Hi Dear Gurus/ Experts,
I am desperately looking for your guidance, please help me. I am crrently under 3d, my first tier tibunal will be held in Feb 2014 and I will be 10 yr in mid January. I made a flro application which was refused. I was in a student visa with 20 hr work right. I was studying CIMA, my all papers/course work has been completed in the college, but i have 2 papers left to pass. My solicitor had given a letter to my employer on the basis of which currently I am working full time. I am not doing any class at this moment.

My ques is does it affect my 10 yr appliction as I am currently working full time, as per policy guidnce I can work 20 hr when I am on my term time and full time on in vacations. I'll appreciate your kind response.

I have been reading comments on this forum and I need some help. I have already applied for the ILR on the basis of the 10 years rules but recently I had my application rejected twice due to fee payment problems. My last application was related to my marriage to a British citizen but on the third time after the application was deemed invalid for the second time for fee payment,I was granted the discretionary leave and my application refused because according to the Home Office , I was beyond 6 months from the date I was admitted to the UK so I presumed 6 months beyond my last leave ended. First of all I sent my first application on time , 3 weeks before the end of my leave. when the first payment was rejected the Home Office waited 7 months and 1 weeks to notify me that they could not take the money out of my account ( feel like they made sure I was 6 months beyond the end of the leave) now the third time after they manage to collect the fees They refused my application but granted me Discretionary leave. I was not aware of the refusal as I thought that the application was successful but just being considered out of time. Today after reading the letter they sent me 3 years ago I realized that they had in fact refused my application. My lawyer was not aware of this fact when we sent the SET LR form 3 months ago as I did not mention it and send a covering letter asking for the 3c to be taken into account ( concerning the fact I was granted a leave after my marriage application) for the lawful long residency, which the Home Office disregarded at the time. Reading at stories here I believe my chance of success being slim but I would like to obtain some advice as what to do next. I am expecting their decision anytime from now until end of October. I heard that appeal rights do no longer exist and one can only ask for a review.... Also since I was granted a discretionary leave, Should I in case of a refusal apply for a discretionary leave with more limited chance of success as I will again be considered as an overstayer instead of pursuinga appeal or a judicial review of the ILR?

Hello M2013 ,

As per as your situation you can apply on or after 20th March 2015 however your current visa is expiring on 17th february 2015 so you have regularise your stay from 17th Feb 2015 till 20th March 2015 atleast ...so you are short of almost 32 days ...will advise you to regularise your this visa by applying any other category and vary your application on or after 20th March 2015 ...

Thanks Shahjee.. just unbearable for me to let go of my passport for that long. I travel a lot for work/leisure and im putting on hold my entire life while they decide this application but this also has got to be done.

Donot worry it will be positive decision because march and April applicants getting ILR. Are March or April applicant? Stay hopeful you will get good news.

What I have noticed from our 2 applications that my wife's case
Was in Bristol which is running around 10 days quicker. And my case
Was in Liverpool which is little slower.

My prayers with all who is waiting for theirs approval.

Can shahjee or anyone else please guide me,

When you guys applied FLR (M) for your spouse along with your SET (LR) application;

• Did you guys sent your spouse FLR (M) on SET (LR) address in same envelope or send it on its own address?
• Did you guys attach the certified copy of you passport & BRP by notary etc or without certification.

Hi Guys,

Does anyone know when the 10 years rule will stop?

My wife been here since October 2007 and now I have to apply for her FLRM but according to the new rule they will give her 2.5 and another 2.5 years visa but she will qualify for 10 years on October 2017.

I'm wondering would I be able to apply for her ILR that time base eon 10years or not ?
