FLR (M) financial requirement Cat A

Hi,

My wife is about to apply for Spouse visa. We understand the threshold is £18600 and is easily reached when combined between us.

She started work 21 Oct 2013 and she has 10 pay slips
I started work 17 Feb 2014 and I have 6 pay slips

Appointment in person booked for 04 August 2014.

After reading the guidance notes, Financial requirement for Cat A says that we have to be employed with the same employer for 6 months or more.

Does this mean we will fail the financial requirement because on 4th August 2014 I will not have worked for full 6 months even though I have 6 pay slips?

Please help on this urgent query. I have asked a straight forward question but please let me know if you require any more info to help.

It's tricky going through cat A,since cat B doesn't need to be 6 months and you're combining income with your wife,that might be better.
Or you must be prepared to explain why you've applied when you knew you haven't done 6 months.
I also hope you've got the relevant letters from your employers,obviously from yours and your wife's employer? This letter will state how long you've worked for your employer as one of the four important points needed from employer.

Thanks for your reply.

Here is an update. I have rescheduled the appointment for 15th Aug 2014. Her visa expires 16th Aug 2014.

We each have 6 months bank statements that correspond to our payslips.

Both have employment letter and contracts that states our starting time. 21 Oct 2013 for her and 17 Feb 2014 for me.

All other evidence are up do date.

Now the question is, how does UKBA calculate a calendar month? If it is 30 Days then including the 15th August 2014, I would have been employed for exactly 180 days on 15th August 2014.

Now regarding Cat B, we haven't been working for 12 months, that being a requirement I don't think we can choose that category.

Ok,cat B can't work with what you said.
The important thing will be the fact that you've been paid for 6 months and it shows on your bank statements and have the payslip as well.
May you not meet a very callous I.O,I don't think it should be a prob,you obviously won't go there and be telling him what you've not been asked,would you?
Changing the date makes a lot of sense,if that helps to have your recent payslip and bank statement

I already have recent payslips and bank statements.

Now that I have changed the appointment date to 15th August 2014 it gives us some extra time.

All I'm bothered about is how UKBA calculates a calendar month. I have heard of some horror stories when they mess up with the dates.

I'm only handing over information that's asked for and nothing extra that might jeopardise the case. Everything is straight forward. I just need to confirm how UKbA calculates a calendar month.

You may be ok as it's only a day or so.

When did you meet the 18,600 mark with combined earnings?
You can use cat B, you don't have to have worked for the entire 12 months to qualify. To minimise your anxieties you could just go with that because the only requirements using Cat B are you earning equivalent of 18,600 currently AND have done so in the last 12 months.

@ sohopeful, just checked cat B requirement again and you're right!got confused when he said he's combining income as well,which is Ok.

hi i am new to this forum just need some information regarding my wife visa on flr(m) in cat A.
I started work on 1st march and my wife visa will expire on 7 September 2014(PSW dependent)
i worked 200 hrs in march @8 pounds per hour which equals to £1600.
April= 175.5hsr*8= £1500
may= 200hr*8= £1600
june= 200hr*8= £1600
july= 220hr*8= £1760
august will be approx 220hr*8=1760
i get montly wages and payslips. my question is can i qualify for CAT A? I have seen on this forum that the HO will count the lowest monthly income which in my case is 175hrs = £1500
CAN I QUALIFY FOR CAT A?

You will be fine if you're in non salaried employment, with what you've stated,it seems you're in non salaried employment and you should be fine.
Lowest monthly income is used where a sponsor is in salaried employment, total income in 6 months is used where a sponsor is in non salaried employment.

hi AMBER AND RAYKING need help.... i will be sending my wife documents for FLR(M) soon...the document im sending are:

FLRM Form

employement letter
6 months pay slips( ALL wages paid on 30th of every month accept one paid on 28th... is that fine)?
4 joint account bills( British gas, Severn trent water, tenancy agreement, council tax (may 2014))

Tv licence and bank statement on my name and 2 bills on my wife name 1. appointment letter from NHS AND driving licence counter part( do i need to send the driving licence CARD as well or jusT THE counter part )?

photos of me(1) and my wife(2)
photo copies of my passport and bio matric
original passport of my wife


please let me know if anything else i need. YOUR COOPERATION WILL BE HIGHLY APPRECIATED thanks

Proof of address needs to be proof of ownership or renting and people usually include a council tax bill for the current year.

one more question plz help... im applying flrm for the first time for my wife she is on PBS dependent visa now, my question is do i need to send 6 joint items of correspondence with my application? i saw on this forum saying that 6 items of correspondence is only for unmarried partner and those who applying for flrm extension. plz help
