PBS Dependent or FLR(M)

Post by virus.vinay » Mon Sep 01, 2014 4:26 pm

Hello,

My wife switched from Tier 2 to Tier Dependent in October 2014, which means she has to spend 5 years as a PBS dependent before she becomes eligible for ILR.
Her Tier 1 Dependent is valid till May 2015. I recently received my ILR.
Now when we apply for her extension I understand that we would have to use PBS dependent form (https://www.gov.uk/government/uploads/s ... _07-14.pdf) instead of FLR(M), which would reset her 5 year period.
Question is:
1) Is the above understanding correct?
2) When she gets an extension, how long does she get the extension for? Would it be for 10 years as my ILR is valid for the next 10 years?

Any help/ pointers will be much appreciated.

Regards,
Vin

If you were granted ILR as a PBS applicant a PBS dep extension is correct. The leave would be granted for 3 years, on a 5 year route to settlement.

Thanks Amber.
Can you please tell me whether the "no more Tier 1 extensions from April 2015" and "no more ILR from April 2018" is applicable to dependent route as well cause then that will talk to up our situation.

Cause even if my wife extends her stay in March/April 2015 and gets a 3 year visa which would be valid until April 2018, she would be still be short by around 6 months for her ILR eligibility.

PS: Thanks for deleting the duplicate post.
