PBS dependant to ILR

Hi,

I am on a Tier 2 ICT VISA since May 2009 and would now be applying for ILR. My wife had been staying with me since last 5 years, PBS dependant extended last in Oct2013 till Oct-2014.

I would not be able to apply my wife's ILR along with me.

Just wanted to check, once I get ILR can I then apply her ILR ?

If yes, what form should I apply ?

WOuld she still be applicable for naturalisation after an year ?

I have been told SET(M) for settlement of wife, whereas you say SET(O) could you please throw some light on this to clarify the doubt.

SET(O) is correct. B1 English, LIUK and cohabitation proof required.

Hi Amber,

Thanks for the prompt reply. But one of my friend had a similar situation earlier and his wife applied on Set(M) after the guy received ILR.

I too read Set(M) and it says 'ILR in UK as the partner of a person present and settled in UK' . This makes me feel as if my wife wold fit in this criteria.

To clear my doubt, could you please clarify when SET (M) is used and what is the difference between two.

A PBS dep cannot apply for SET(M) unless s(he) switches to FLR(M) which would be a new 5 year route to settlement!
