Tier 1 2rd Extension

Tier 1 2rd Extension

Hi all

I know HO don't entertain any tier 1 extension after 5 april 2015. I was bit worried about my visa situation.

My first Visa information is below

First Tier 1 (G) applied on 31March 2010 (before 6 April 2010) valid until April 2013
1st Extension applied April 2013 valid until April 2015

During my first visa i was outside uk for 1.5 years thats why i need another extension which i'm going to apply in April 2015.

My Questions;

1 - Now when i will apply for my 2nd extension will i get 3 years or 2 years extension?
2 - I know main applicant can not apply from outside UK but dependent can apply. But can my dependents apply from outside UK after 5 April 2015?

any answers with HO website link will be much appreciated.

1. 3 yrs as per 245CB of immigration rules.
2. Yes she can apply from India for her entry clearance, which means any time she spent prior to applying from India will be lost, i.e., her ILR clock will be reset.

i might be wrong but when i read through 245CB of immigration rule it seems like my extension will be 2 years not 3 years.

The Rule says

Leave to remain will be granted for a period of 2 years, to an applicant who has, or was
last granted, leave as a Tier 1 (General) Migrant under the Rules in place before 6 April
2010.


Although my last visa granted on April 2013 (2 years) but it was under rules "pre April 2010"

Please correct me if i'm wrong. it is really confusing.

Indeed it is. This has been discussed to bits and you can see experience of many members getting 3 yrs. In some cases erroneously 2 yrs, after which members have written back to case workers and got it corrected.
