Tier2 ICT - ILR - continuous period

Post by pradkpm » Thu Sep 11, 2014 11:43 pm

Hello,

My Query is related to applying for ILR

I have a Tier 2 ICT visa starting from September 2009 and extended till September 2015.

I have been ON and Off to UK since my first visit with no more than 180 continuous days in any 12 months, except being out of UK for 8 months continuous in the year 2013.

My question is : Can I split this 8 months into two years having 6 months in one year and the other 2 months in the next year please?

Below is the split..

Start Date End Date Number of Days outside UK
07 March 2010 07 March 2011 ==> 166
07 March 2011 07 March 2012 ==> 21
07 March 2012 07 March 2013 ==> 74
07 March 2013 07 March 2014 ==> 179
07 March 2014 07 March 2015 ==> 16

subject to checking the calculation of the number of days this is OK. Note that only whole day absences count, days of travel don't. The absences must be confirmed in writing by your sponsor and they must be for a permitted reason.
See p19:

Apply on 07/03/2015

Thank you for your response, Manci.

I was reqeusted to work from India for these gaps and I've requested the sponsor to provide a letter stating the same.
Hope this should suffice?

Hi Manci,

Can you please tell is this 'no more than 180 continuous days per year' applies for Tier 2 (G) extension also or for T2 extension it is just 1 month ?

Thanks,
Sid
