eu 1 form query - no stamp in passeport

Hello!
We have applied recently for EU1 form for my non EEA husband.
Im an EU Citizen living in Ireland for last 3 years.
He is living here last 3.5 years, as a student.
We made that application after getting married, as advised by Garda Officer, but that time his Garda card was expired.
We cannot produce the legal evidence of residence in another member state, so I think our application will be turned down.
What will be his status here? Will he have to leave the country?
And then re-enter on a spousal visa?
Is that true that he cannot work/study while applying for EU1 form?

Please advise.

How will he be able to get a spouse visa if you are not an Irish citizen?
Which EU state are you from?

when he will be denied the residency card, so I think he will have to go back to Bangladesh.
Can I apply then for spouse visa to bring him here to ireland?

Are you in Ireland or the UK? Either way, you cannot apply for the spouse visa. You apply for the EEA family Permit.

And you're planning on living in Ireland? Have fun. :lol:

I think Sakura's 'fun' reference was to the immigration 'fun' that is the Irish Gov's interpretation of the EEA directives, ie not in the spirit of free movement...

U should apply for the EEA family permit as Sakura said, it's not clear as to wheather u already have tried that tho.

Also it's not clear if ur husband is legal now in Eire, can u confirm?

I dunno - I'm out of my depth here. I dunno if in Eire an outstanding application means the old visa is considered ongoing.....

I'll leave this to the Eire experts...

Heh, sorry! I am not laughing at the situation, just the horror stories in the Ireland immigration section. It sounds like Ireland is (one of) the worst places to choose to live via the EEA route! If you look through the posts, you'll understand what I mean.
