My wife FLR (m) application got refused for TOEIC

Hi there!

We went for my wife FLR (m) application last 18.08.2014 in Croydon peo. That day we given one normal letter need further enquires. Today morning we got refusal regarding Toeic certificate they refused the application. They also mentioned ets confirmed UKVI speaking test done proxy taker which is completely wrong. Though I understand most of the cases got deception. Even they dont consider the application under the human rights. They just informed leave this country within 10 days and appeal from back country.
My wife just keep saying how she accept this sort of bloddy decision.

Guys please give us suggest ion when we will get JUSTICE.

You can take a new immediately and can apply for new flr(m)..

Her student visa wil be expired 21 October 2014. Theu kept her passport and return all ptger dicuments.Also given appeal right. Please suggest what we will do? Even last month she completed her BA degree from Geernwich university.

Then you better exercise that right, just in case they stupidly refuse to reconsider the decision.

The appeal ought to be exercised, and please ensure it is done within the 10 working days limit.

Thanks a lot. We will do appeal lodge next monday. In refusal letter they even didn't consider human rights under europian law. Importtant thing is I am from India and she is from pakistan.

Yeah, the refusal don't seem to add up.

Is there any child in your relationship?

yes we meet the financial requirement.
She finished her course last month.i also let you know that my wife in the mean time she did trinity college london a1 certificate with distinction.Home office only raise the issue in a year 2013 she used B2 toeic certificate for her student visa extention which was obtained via deception. Ets confirmed speaking test was taken by proxy test taker which was fully rubish.]

Is the decision an Out of country appeal or an in country appeal.

I am not sure if they are seeking to refuse based on 320(7A).

By virtue of A320, it seems to me, that she cannot be done for deception used in previous application.

If there is an out of country appeal, then the only remedy open to you will be a Judicial Review, and a Pre-Action protocol will firstly need to be send before pursue a JR claim.

In country appeal.Time limits 10 days. Home office also informed if my wife not appeal then leave the country immediately.

You have my suggestion, which is to appeal and challenge the refusal.
