Enquiry regarding Tier1/ILR

Hi Guys,
I will be applying for Indefinite Leave To Remain come October 2015. My concern which i wish to clarify is that i came to the UK on the 89th Day from issuance of my Tier 1 General Migrant Visa. Do I need to extend my Visa early or can i straight apply for Indefinite Leave to Remain.

Although i have read on guidance notes for the above mentioned category but there is some contradicting information on other forums. Could you please advice what would be the best course of action for me. Also having read on internet that Tier1 extensions will no longer be available on from April 2015 which means if I have to apply for an extensions it would be before that time.

please see the dates below for the above calculation.
Visa issue date : 9 Nov 2010
Date of Entry : 5 Feb 2011
Current Visa Expires on : 8 Nov 2015


Please suggest

You will be fine to apply for settlement 28 days prior to 08 Nov 2015.

Hi,
Thanks for your reply, I called UKBA croydon centre, they confused me they said ILR starts at the time of arrival in UK.

Yes, that is true, if you entered after 90 days of entry clearance.

See pg 22 of Calculating Continuous period (click)

The period between entry clearance being issued and the applicant entering the UK may be
counted toward the qualifying period, as long as it does not exceed 90 days.

Yeah, I have seen that today in guidance note. I had emailed them around a month back, but they haven't replied. Do you know any valid email address.

Or do you think safer side, I should apply Tier1 early extension?

Mate, it is clear, you don't need another extension to be eligible to apply for ILR.
