It could be, if an immigration officer is of the view that an EEA national is not a "Qualified Person", then there will be strong case to refuse on the basis that the EEA national or the family member will not be residing in the UK in accordance with the EEA regulations.dalebutt wrote:I don't think they would know, and entry cannot be denied on the ground in any case.
As long as they have CSI they can sit at home do nothing and be self sufficient. It is rare that the IO would evaluate whether an EEA national is qualified person or not because it is very easy to qualify.askmeplz82 wrote:I understand what if EEA is not exercising treaty right anymore after 3 years. Just sitting at home and doing nothing
dalebutt wrote:That scenario sound very extreme, family members have a derived right, refusal of entry to such a family member cannot be justified whilst the EEA national is still residing in the United Kingdom in my view, it is not UKVI's policy to refuse admission to family members in such circumstance, it will be hypothetical and would amount to a significant error if they refuse admission in this scenario described by the OP, as the EEA national may resume economic activity at any moment, it may only affect time to acquire PR but certainly in my view cannot amount to a refusal of admission.
