Hi Guys.

I'm deflated atm to say the least. The application was refused. Decission was made on the 12th September allready and was only posted yesterday , 29th Sept 2014. :(
My wife have been self employed in the period for the 5 years and as such we have submitted her tax returns and letter from accountant stating this fact.
They refused cause they say we should have send duplicate invoices that was send to clients, proof that invoices was paid , bank statements of the business account, balance sheet showing overhead costs , water, elec , gas, phone etc etc. Im sure this was not asled for in the form i filled in but will have a look tonight. :(

So i have a choice, appeal or leave the uk, they say it very politely in the letter. Appeal cost more money , time and effort. I will appeal off course.

So I'll be with you guys for a while yet.
Anyone with information on the appeal process or some hints etc would be much appreciated.

Hi Hybrid,
I am so sorry to hear that.

Completely ridiculous.
Did you attach SA302 , NI contributions etc?
Do you have copy invoices available?
I would go for appeal if you havent got the documebts they are asking for.
I have same situation though. I applied on wife's self employment basis too.
I attached random invoices, normal bank statements, website print outs, SA302, NI contributions statement, ads, Yell.com print outs, customer testimonials etc.
Still waiting though.

Sorry to hear that
But chin-up nothing serious .
First of all it's not mandatory to keep balance sheet if self employed
Ring Hmrc get them copies of her sa302
And take them to a tribunal you will win easily
But first write a letter to the caseworker
Stating the relevant eea laws
Your are not obliged to supply them any bank statement
The regulation only ask you to prove exercising treaty rights so the sa302 is more than enough if you can get that for all the period she was self employed you will be home and dry.
Write to the case worker first stating that invoice and balance sheet are irrelevant what matters is treaty rights and the sa302 proves it

Mate is not the end of the world I can see you winning the case so easily in a tribunal

Hi all, see below for our timeline for combined EEA3 (German) and EEA4 (Turkish) application:
  • EEA3+4 Applications sent: 28 July 2014
  • Cheque payments taken: 4 August 2014 (date on bank statement)
  • Payment reference letters arrived: 4 August 2014 (dated 30 July)
  • Confirmation e-mails arrived: 12 August 2014
  • EEA4 Certificate of application arrived: 14 August 2014 (dated 11 August)
  • PR Documents arrived 30 September 2014 (dated 26 September)
The applications were pretty straightforward: treaty rights exercised for 3 months as a jobseeker and as an employee for the rest of the five years.

Wait! - no appeal, no leaving UK. The letter is sent out to everybody and is a standard blah-blah-blah.
Remember, as the husband of an EU exercising their treaty rights you can be here even without that stamps.

Please write exactly what they are saying, point by point, I'll write a response for you - based on what I'd done - and send another application. It is faster, easier, and yes way cheaper. Can also help you write the whole cover letter, I'm better at blah-blah that even the home office lol :mrgreen:

I didn't enclosed Pre paid SD but It came with special delivery envelope . when I received it I straightaway took and open my passport they ve cancelled my eea2 visa. When i saw it , I was like OMG lol. Then next page i ve seen Eea4 visa :) . Happy moments so exciting . good luck matey

Your timeline is very similar to mine so I'm praying that mine will land soon too. I'm getting anxious as my work requires me to travel and I'm not too sure how much longer they will be patient in waiting!!

Hopefully you will get yours soon. Just curious, are we allowed to request for our passports back while the case is being considered (without stopping the application of course)? Does anyone know?

Hi Sarah,

Yes, you can request your passports without affecting your application once you have received your coa.

Just fill in the. online form on ukba website.

Thanks kkuk! Just planning ahead in case we still have to wait well into Dec for the PR card, I'll have to request it as we will need to travel for Christmas. Thanks again!

Hi behold,

You will receive your coa any day now.

From different posts on this forum its safe to assume roughly 2-3 weeks to receive it after you made tour application.
So fingers crossed

Here is my timetable...

Applied for EEA4 on 15th Aug 2014
Application received by HO on 20th Aug
Money taken from my account on 26th Aug
COA issued on 4th Sept...


Applied on the basis of my husband's self-employment plus he is already settled here permanently.

My question is - do we receive a letter from HO asking to enrol biometric Information?

Question i been wanting to ask for months.

if you apply for EEA4 becos your spouse EEA national acqiured a permanent reside card,and you had months or few years left on your EEA2

if the HO refused your EEA4.

what will they do to you current EEA2?

Good evening everybody,
I would like to ask for your opinion. I send both my EEA3 and EEA4 applications this tuesday 30/09, they received it on the 01/10 and on the 3rd took the payment for the EEA3 but did not take payment for the EEA4. I checked my card and due to an unexpected charge turned out to be over the limit. Do you think they tried to take the payment for the EEA4 but could not?, if so do you think I should call them or would they reject the application altogether?

yes, if HO don't get payment, your application becomes invalid.
Most likely from here you'll get a refusal letter some time down the line and would need to apply again, so CALL THEM ASAP :)

There was a number earlier in this thread (like a couple of pages ago, not the very beginning) - call monday

it's not going to be a refusal, just deeming the application invalid. and in any case, i doubt they keep a "log", i mean every application is a new application ..although who's to know for sure.. Anyway, don't sweat too much and get calling first thing in the morning and dont give up until you talk to smb. But worst comes to worst - they'll return your stuff and just send it again. No problem here
