Tier 2 Extension

HI Guys, I have a quick question

I got my Tier 2 visa on 03/03/2012 on soc code 3543. My visa runs out on March 2015.

Question

1. Can I apply in September 2014 for my extension or is there a time line in which I should apply for the extension. I have some business travelling in January-2015 and I want to have my passport for that.
2.Will I be able to apply in the same soc code and same salary as I did last time in 2012.

Kindly help me with the questions or direct me to proper links where I can get more information.

Since your initial leave was before June 2012, and if you are still doing the same job (SOC code 3543, NQF level 4), you can apply for an extension any time with a new CoS. Min. salary £20,500 for a 39 hour week.

Thanks Manci, But Para 69 is regarding the T2 General new rule introduced in this April. Please correct me, If I am wrong.

69. If you are already in the UK and were initially granted leave in Tier 2 (General) under
the Rules in place between 6 April 2011 and 13 June 2012 and you have not since been
granted leave to remain, entry clearance or leave to enter in any other route, you can
apply to extend your stay for the maximum period of 6 years. Please note that you will not
be able to extend beyond 6 years. You will also not be able to reapply to return to the UK
under Tier 2 until 12 months after your last leave under Tier 2 expired or can show you
have been outside the UK for 12, whichever is sooner. This will be the case even if you
have been in Tier 2 for less than 6 years. The Certificate of Sponsorship must confirm
that the job is at or above NQF level 4 (or the equivalent in Scotland). The Certificate of
Sponsorship must also confirm that you will be paid at or above the appropriate rate for
the job. These requirements are set out in the codes of practice on our website at: www.

Hi,

The other issue is when I was accepted in soc code 3543- account manager in March 2012 - there was no specific code assigned for account manager position. However there is a new code specifically for account manager in new rules. Will this make any impact for me.

your sponsor has to decide what is the most appropriate SOC code for your job. If it is not 3543 any more than a change of employment application will be needed and the sponsor will have to do a RLMT before assigning the CoS.

Hi, do you think there will be an issue- if they go ahead with the same code for extension. I am doing the same job on same salary- its just that there is a new separate code for the account manager position.

Hi,

I need your help with few questions.
I am currently on tier 2 visa with the code 3543 as Account Manager and my visa will expire in Mar 2015.

- I have just been promoted to a senior level and salary has increased by 20%- Does my company need to report this to UKBA ?

- I am also hopeful to move into a new role as Sales Manager by the end of this year. Now, when I applied for my tier 2 in Mar 2012 there was no soc code for sales manager but now there is one available 3545. Will my company have to do RLMT for this move or can I use the old 3543 code and get into this new role.

Please share your comments.

If the SOC code for your job has not changed following the promotion your sponsor should report via the SMS the promotion or change of job title and the increase in salary.

If your SOC code changed you must make a change of employment application with a new CoS

Hi can you anyone reply for below please


I'm applying for my tier 2 general extension in December 2014. Just wondering Is there any maintenance funds need to shown for extension. And I have a £3000 over draft in my salary account, every month I get a salary of £1800, even after my salary get credited my account would still show in negative. I am repaying about £200 a month to close this OD ASAP. Does this anyway affects my visa extension.Thanks

Now will my company have to do RLMT to make me a sales manager or there is any other provision. Also my promotion will happen on 01 st December and my current visa runs out on March 2015.

Hi Manci.

Could you kindly advise me ,please ?

I started working for my employer in May under tier 2 visa. Changed from PSW. The salary on the SOC code is £23000. My employer had a meeting with me last month and said my salary has been increased to 28000 with immediate effect.I am still doing th same job under the same SOC code.

Do I need to inform the UKBA about this. Please note my last month salary took into effect the new salary pay.

Would really appreciate your advice.
