Can I apply on 15-Nov-14 for ILR?

Hi All,

I am currently on Tier1 (3 + 2yr) visa valid until 10-Dec-2014 (in 2 months from now).

My visa timelines as below


Tier1 - Valid From ====> 10-Dec-09 Valid To====> 10-Dec-12
Tier 1 Extension - Valid To====> 10-Dec-14

I entered UK on 3-March-2010 which is 83 days after my VISA start date. So I think I can go under 90 days concession rule. I am also thinking to apply on 15-Nov-14 as it is 28 days before I complete 5 years.

Please can someone confirm my understanding on 90 days concession, applying 28 days before 10-dec-2014.

Yes you can apply 28 days before to 10 Dec 2014.

ThanKs Malik for taking time to respond to my post.

I am trying to book an appointment for my ILR and for the form SET(0) and for the option

"Which category of leave are you applying for?" I think i must choose Tier 1.

Other options available are

- Tier 2
- Other Main Applicant
- Dependant

Please can someone confirm this as the question is bit confusing me.

Yes Set (O) under Tier 1 G is right option

Thanks all for giving me constant support through this forum. I have got 1 more question on the Set(o) application form. May be this is silly but wanted to confirm rather than presuming.

Myself and my son will be applying for ILR this Nov. My husband will be applying later next year as he is in independent Tier 1 visa and will be eligible next year.

If I include my son's details in (section 2 as below) will suffice or do I have to submit another application for him and also shall i leave the Partner's column blank as my husband is not applying with me?

Section 2 - Dependants who are also applying
If you have a partner and/or any children under 18 who are living with you in the UK and who are
applying for indefinite leave to remain as your dependants, this is where you give their details.

Only 1 form there is no any other form for dependents include dependent details in dependent section.

Note.
If your baby born in UK than you can exclude his/her application from ILR and later register as British citizenship on MN1 form once you granted ILR.

Thanks Malik for your reply. We have plans to go to my hometown in Dec. Hence would like to apply ILR for my son and on our return we will go for british citizenship as it looks like to register him as British it takes approx. 3 to 5 months as per the current timelines

Hi all again,

One last confirmation on the Set(o) application form. I must have spent 4 years 8 months and 12 days when i apply for my ILR. (This is because: 83 days late entry to UK and applying for ILR 25 days before my VISA expiry)

Wondering if I can mark YES for the below question in the form. (Page 40. Question D1)
