Residence permit torrent downloaded and fined

Post by fun123 » Fri Sep 19, 2014 6:53 pm

Dear board,

I have one specific issue I would like your help. I stayed in Germany 5 years back for 1 year.

I was caught up when using utorrent for downloading movies and got fined some amount. I paid the amount.

Now after 5 years, I am about to apply for resident visa again. Will there be any problem for me to get the residence permit? Please help.

Who exactly fined you, and for what exact reason? How much were you fined?

I got a notice from lawyer for settlement of 1500 euro. And it was paid. The rubbish which I downloaded was released in Germany in Deutsch version. And the German company which bought this rubbish sent the notice through lawyer

It does not sound like you have been charged with and convicted of a crime. Or put another way, this was nothing to do with the government.

It sounds like you reached a civil law settlement with somebody over a private matter. An expensive settlement. Do you still have the papers of the settlement agreement? Were you represented by a lawyer?

Sorry for the late reply.... Yes i have the settlement document and I was represented by a lawyer. If this is the case then will it have any impact on the residence permit? Kindly help me

You did not answer my question. Were you charged with a crime by the government? Who is the other party to the "settlement document"?

The notice was sent by film distribution company, it was not government. The settlement was done between me and the private film distribution company. In that i was asked to pay the amount due to torrent downloading of their rubbish. Kindly let me know if this information is enough. Thanks.

Then this is a private agreement between two private parties. It is nothing criminal. It is similar to the situation that I had agreed to paint your house, but I could not do it for some reason, and so I pay you some compensation money.

Thanks a lot. Now I understood that I cannot have issue in getting the visa due to the torrent issue. I am going ahead and apply for the visa.
