ILR application eligibility timelines - kindly help

Hi Gurus ,

I am on TIER2 ICT visa and looking forward to apply ILR this year.

My visa first got stamped on 23/08/2009 for entry clearance and I traveled on 06/11/2009 to UK.

My query is that can I consider my entry clearance day i.e. 23/08/2009, as my start date for calculating the 5 years period, as my first date of entry to UK (06/11/2009) is within 90 days from when the date of entry clearance was awarded.

If Yes, will this mean that I will be eligible to apply anytime for ILR after 23/08/2014.

My current visa is expiring on 2/10/2014 so if i can get 90 days grace period i don't have to apply for visa renewal for month.

the 90 day concession applies to you and you will not need an extension. Make sure you apply for ILR before your current visa expires

Hi Mancy,

My Tier2 ICT visa issued on 18-Mar-2010 and i have landed in UK on 20-Jun-2010 , Since then i am continuously working in UK without any breaks.
I have couple of queries.
1. WIll my start date is considered as 20-Jun or 18-Mar for my ILR calcuation?
2. Am i Eligible for ILR after 5 years of my stay in UK either continuing in Tier 2 ICT or by switching to Tier2 General? If Yes , When i can apply for ILR?

Dear experts ,

i am planning to switch from tier2 ICT to tier2 general next month. will my above eligibility to apply ILR in July still be valid .
Will i still be requiring letters from my previous employer.

Your ILR eligibility will not be affected by the switch from T2 ICT to T2G.
You will need a letter certifying your absences from both employers and a letter from the new employer only certifying that they still require to employ you and that you are being paid at the appropriate rate.

i have taken some paid annual leave (not more than 5 weeks) during my stay in U.K with my present employer .do i need to provide any documentation on it as i not sure if my employer will give any letter regarding these paid leaves.

you will need a letter from the employer confirming your absence(s) on annual leave

Could you please confirm how did you calculated your due date of ILR?

Based on VISA Issue Date or Based on Travel Date?

I have similar situation,
My Visa Stamped on 19-Feb-2010
I travelled on 09-May-2010 which is within 90 days,
So would i be eligible on 28 days before of date of travel or date of visa stamp?

This is really strange, because i Spoke to two Immigration Consultants and they said I would be able to apply only before 28 days of my travel date which is 09-May-2010.

That is why i am a bit confused.
