English Language requirement for Tier 2 General Visa

Post by Ishika » Wed Oct 15, 2014 10:19 am

Hi Moderators,

I hold a Master degree done in India, I can locate my college, degree etc in UKBA pointbased calculator. I see that point based calculator awards 10 points against my master degree. My employer's lawyer is insisting that I need to go thru English Language test because I am trying to gain points against Master degree instead of Bachelors. I thought as Masters is higher degree than Bachelors that is even better but my employer's Lawyer doesn't agree. Any thoughts?

Many thanks,
Ishika

Thanks Manci for the link. Yes it quite clear that anything above bachelor degree should be fine. The lawyer has quoted below from somewhere:

"Immigration Rules (at appendix B point 7) state that Master's or PHD will be accepted if it was taught in a majority English speaking country"

That is why they don't want to take any responsiblity unless I give english langauge test :(

Has anybody got their Tier 2 General visa cleared with their Master's degree?

from App B, para 7 of the immigration rules:

10 points will be awarded for a degree taught in English if the applicant has the relevant level of English language shown in Table 1 and:
(i) has obtained an academic qualification (not a professional or vocational qualification) which either:
(1) is deemed by UK NARIC to meet the recognised standard of a Bachelor's degree (not a Master's degree or a PhD) in the UK, and UK NARIC has confirmed that the degree was taught or researched in English to level C1 of the Council of Europe's Common European Framework for Language learning or above

if the points based calculator shows 10 points for your masters degree it means that UK NARIC accepted it as conforming to the above rule and you'll get 10 points when you apply for your visa.

Your prospective sponsor has no "responsibility" in the matter, the visa application will be yours, not the company's, they'll only have to assign a CoS to you

If your BS level degree is not from English speaking country, I would recommend to you go for IELTS test.

Hi Moderator and Ishika,

I am in the same situation, I hold a Master's degree in India and to apply to Tier 2 General, I got NARIC assessment for my Master Degree from India and NARIC has stated that it is equivalent to British Master’s Degree and meets the requirement of CEFR C1 level .

Is this document sufficient for claiming the 10 points or do I need to have a NARIC assessed degree that is strictly equivalent to a British Bachelor’s degree.

Hi Ishika, I see you had the similar issue, did you get your UK VISA with this or you had to give english test separately?
